MINUTES <br />CITY COUNCIL <br />AUGUST 23, 1995 <br />location. <br />Fahey again suggested that the matter be tabled pending <br />additional information. He suggested the building <br />permit application for the Leibel property be reviewed, <br />as well as Council discussion of the Leibel lot split. <br />The City Attorney pointed out there is a provision in <br />the Code which says no accessory buildings, except for <br />farm buildings, are allowed in any required yard other <br />than the rear yard. The Attorney asked if this was <br />considered the Leibel's rear yard? <br />Scalze asked if the Leibel property was considered to <br />have two rear yards and no front yard? <br />Fahey pointed out the rear yard would be behind the <br />house. However, the Planner is saying since the Leibel <br />property is adjacent to the Novak~s rear yard, it <br />should be treated as a rear yard. Fahey asked if the <br />ordinance clearly states that this area is not a rear <br />yard? <br />Fahey again suggested tabling action pending additional <br />information. <br />At this point Scalze withdrew her motion and Fahey <br />withdrew his second. <br />Scalze stated that she had no problem tabling the <br />matter until the next Council meeting, suggesting <br />staff research similar properties accessed via long <br />driveways. Fahey also asked for the Council minutes <br />when the CUP ordinance was drafted so he could review <br />this discussion. Leibel building permit information <br />was also requested. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 95-8-195 - TABLING ACTION ON THE LEIBEL <br />CONDITIONAL USE PERMIT APPLICATION FOR SECOND GARAGE IN <br />ORDER TO GIVE THE COUNCIL TIME TO REVIEW ADDITIONAL <br />INFORMATION WHICH HAS BEEN REQUESTED <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) Fahey, Pedersen, LaValle, Morelan, Scalze. <br />Nays (0).
