MINUTES <br />CITY COUNCIL <br />AUGUST 23, 1995 <br />he is planning to sell his house in two years when he <br />retires and does not want anything to detract from its <br />value. Novak pointed out that Mr. Leibel does not want <br />to relocate the garage because it will cost him more, <br />and Novak felt the garage should not cost him anything. <br />Leibel pointed out the Novak's have a large house on a <br />small lot and were granted a variance to construct <br />their home. Leibel suggested that Novak could have <br />purchased the property. <br />Novak replied that he was not able to afford the <br />purchase of the property. <br />Fahey asked if there was any provision about the size <br />of a property in relation to accessory buildings. <br />The City Planner replied that the only provision is <br />that not more than 25% of the rear yard can be covered <br />by accessory buildings. Setbacks most also be met. <br />Fahey felt this provision implied that accessory <br />buildings should be in the rear yard. <br />The Planner stated that the code says an acoessory <br />building cannot encroach into the front yard. Again, <br />the Planner stated that front yard is defined as the <br />first 30 feet back from the road right-of-way. A <br />property owner has the ability to construct their house <br />further back on the lot than the 30 foot line. <br />Scalze stated that front yard is the first 30 feet of a <br />75 foot lot. <br />Morelan pointed out that the Code does not specifically <br />address an irregular-shaped lot. Morelan stated that <br />to him it was a question of what is fair. If the <br />Novak's are able to build the same garage 10 feet from <br />the same lot line, why shouldn~t the Leibel's. Morelan <br />also pointed out if the Leibel house were turned <br />around, and this were the back yard, there would be no <br />question. The garage would be allowed in the location <br />proposed. Morelan stated he did not disagree that the <br />garage will impact the Novak's view. But how much, he <br />did not know. Morelan stated that the garage will <br />impact the view to a greater degree because Bob Leibel <br />has a nice lawn in that location which is proposed to <br />be replaced with a garage. However, the garage may be <br />preferable to the outdoor storage of boats and other <br />items. <br />7 <br />
