MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 1995 <br />was substandard as well as the construction work. <br />There is standing water on the street which is <br />attributable to some degree to the fact that the wear <br />surface is not in place. The pavement is settling in <br />some areas, sand is being dumped into the McDonough's <br />driveway, curb and gutter is broken. Nagle reported <br />that the contract calls for three inches of top soil <br />under sod, and there is no top soil under his sod. <br />Nagle stated that there was no one observing that the <br />project was done property. <br />With regard to communication issues, Nagle reported <br />that communication with the engineering staff was good, <br />communication with the contractor was excellent, <br />communication with the City was non-existent. The City <br />communicated only in generalities. If there would have <br />been communication throughout the process, this could <br />have alleviated some of the property owners' concerns. <br />Pedersen pointed out that the City Engineer is an agent <br />of the City, therefore, communicates for the City. <br />Nagle stated that Paul Heuer is a technical person in <br />charge of seeing that the project is being constructed <br />according to design. However, is in no position to <br />tell property owners what actions the City will take <br />against another party. <br />Morelan asked Nagle his specific suggestions for <br />improving the situation in the future. <br />Nagle reported the City sent letters out on the mail <br />box issue as well as on school buses. Nagle suggested <br />that more written correspondence on a periodic basis <br />would be good. Having City Public Works employees <br />visible and able to answer question would also help. <br />Nagle stated that he was not convinced that the City <br />got a good quality job, nor does he have faith that the <br />City will act on his behalf with the contractor. <br />Morelan replied that property owners can be assured <br />that the City's goal is for a good, quality job. <br />Nagle questioned whether or not that goal would be <br />achieved. Nagle asked if the performance bond will be <br />withheld to ensure the quality of the project. <br />Fahey replied that, if necessary, the City will draw <br />against that bond. <br />24 <br />
