MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 1995 <br />would be taken off the tax rolls entirely. <br />Fahey asked if there was anyone from the general public <br />present wishing to comment on this matter. <br />Paul Martin, 2733 Lakeshore Avenue, pointed out that <br />the project is not complete. There is still patching <br />to be done as well as the final lift to be added. <br />Martin suggested that the project be assessed once the <br />job is completed. Martin also questioned whether the <br />City could prove that the amount of the assessment will <br />increase property values proportionately. Martin also <br />suggested that a shoulder should have been striped <br />along the roadway for a walking path. <br />Fahey commented that deferring assessment of the <br />project until next year results in an additional year <br />of interest on the bond. That cost would have to be <br />passed on to the property owners, thus increasing the <br />amount of their assessment. Fahey pointed out that <br />delaying the assessment does not relieve the burden on <br />property owners, but only creates a higher assessment. <br />Mrs. Martin commented that it was her feeling that the <br />condition of the road was worse than it was prior to <br />the improvement being made. Mrs. Martin also stated <br />that storm water drainage is worse. <br />Morelan pointed out that the final lift of asphalt will <br />be installed next year once the street has settled and <br />gone through a freeze/thaw cycle. Morelan asked if <br />payment for the final lift will be withheld from the <br />contractor until the work is completed. <br />The City Engineer replied that that was correct. <br />Mrs. Martin questioned why the property owners are <br />being charged for the final lift at this point, when <br />the City has not paid for it. <br />Mr. Martin pointed out that there is a great deal of <br />traffic through the area from the condominiums to the <br />south, and suggested that these property owners share <br />in the cost of the project. <br />Fahey replied that the law restricts assessments to <br />those immediately adjacent properties which are <br />benefited. Fahey agreed that there are a lot of <br />dollars which have not been paid to the contractor at <br />this point. If the contractor does not perform to the <br />City's satisfactory, then the City can bring in another <br />contractor to finish the job. Fahey also pointed out <br />5 <br />
