Fahey stated that he can understand that <br />the property owners are unhappy about the timing of the <br />project and the quality of the work. However, the City <br />will hold the contractor accountable. <br />Morelan noted that the assessment policy which was <br />upheld in court has been changed subsequent to that <br />court review. The changes which were made in the <br />policy were to the benefit of the abutting property <br />owners, and reduce amounts of assessments even further <br />than what was upheld in court. <br />Aarold Feickert, 2590 Jackson Street, expressed concern <br />about standing water on the street which will lead to <br />icy conditions this winter. Feickert was especially <br />concerned about the intersections of Lakeshore/Old <br />County Road C and Australian/Lakeshore. <br />The City Engineer reported that some modifications will <br />be made in the catch basin structure to allow the <br />intersections to drain better. The Engineer also noted <br />that once the wear course is paved, water will run into <br />the curb and gutter. <br />Feickert pointed out that the County paved both lifts <br />of Keller Parkway this year. <br />The City Engineer replied that only one lift has been <br />paved on Keller Parkway. The County is allowing the <br />street to settle out over the winter with the final <br />lift to be paved next year. <br />Feickert suggested that the City not award any future <br />contracts to Valley Paving. Feickert expressed concern <br />with the way they managed the project, noting that <br />flagmen were not used, there were no barriers put up <br />along excavation areas, and dust control measures were <br />non-existent. <br />Fahey stated that the City does not disagree with these <br />concerns. However, by law the City is required to take <br />the low competent bid. If Valley Paving bids on <br />another City project, the City now has justification to <br />reject their bid. <br />Feickert reported that there are close to 100 cars per <br />hour using Jackson/Old C/Lakeshore. Therefore, the <br />street was constructed to a better standard than the <br />typical residential street.
