MINUTES CITY COUNCIL OCTOBER 23, 1996 Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTION NO. 96-10-262 - DENYING THE APPEAL OF THE DENIAL OF VARIANCE REQUEST FOR SIDE YARD SETBACK ENCROACHMENT MADE BY MR. RICHARD THORP, 470 COSTA LANE, BASED ON THE FACT THAT NO HARDSHIP EXISTS WHICH WOULD WARFtANT APPROVAL OF THE VARIANCE The foregoing resolution was duly seconded by Pedersen. Ayes (4) Scalze, Pedersen, Fahey, LaValle. Nays (0). Resolution declared adopted. PROPERTY Fahey reported that the owners of Heritage Office Park DIVISION- have requested a property division so they can convey HERITAGE a 27-foot strip of property to the adjacent property OFFICE owner. The Planning Commission and the City Planner PARK have recommended approval of the property division. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION N0. 96-10-263 - APPROVING THE PROPERTY DIVISION OF THE HERITAGE OFFICE PARK PROPERTY AS REQUESTED BY HERITAGE DEVELOPMENT CORPORATION OF MINNESOTA SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS REPORT DATED OCTOBER 8, 1996 The foregoing resolution was duly seoonded by Scalze. Ayes (4) LaValle, Scalze, Pedersen, Fahey. Nays (0). Resolution declared adopted. PROPERTY Mr. and Mrs. Oliver Becker, 551 Allen Avenue, have DIVISION- requested approval of the division of their property BECKER into two lots. Both the City Planner and the Planning PROPERTY Commission have recommended approval. The Parks & Recreation Commission has recommended a cash park charge to be collected at the time of building permit application. Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTION N0. 96-10-264 - APPROVING THE DIVISION OF THE BECKER PROPERTY LOCATED AT 551 ALLEN AVENUE INTO TWO LOTS SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS REPORT DATED OCTOBER 7, 1996 7
