MINUTES <br />CITY COUNCIL <br />OCTOBER 23, 1996 <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 96-10-262 - DENYING THE APPEAL OF THE <br />DENIAL OF VARIANCE REQUEST FOR SIDE YARD SETBACK <br />ENCROACHMENT MADE BY MR. RICHARD THORP, 470 COSTA LANE, <br />BASED ON THE FACT THAT NO HARDSHIP EXISTS WHICH WOULD <br />WARFtANT APPROVAL OF THE VARIANCE <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) Scalze, Pedersen, Fahey, LaValle. <br />Nays (0). Resolution declared adopted. <br />PROPERTY Fahey reported that the owners of Heritage Office Park <br />DIVISION- have requested a property division so they can convey <br />HERITAGE a 27-foot strip of property to the adjacent property <br />OFFICE owner. The Planning Commission and the City Planner <br />PARK have recommended approval of the property division. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 96-10-263 - APPROVING THE PROPERTY <br />DIVISION OF THE HERITAGE OFFICE PARK PROPERTY AS <br />REQUESTED BY HERITAGE DEVELOPMENT CORPORATION OF <br />MINNESOTA SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS <br />REPORT DATED OCTOBER 8, 1996 <br />The foregoing resolution was duly seoonded by Scalze. <br />Ayes (4) LaValle, Scalze, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />PROPERTY Mr. and Mrs. Oliver Becker, 551 Allen Avenue, have <br />DIVISION- requested approval of the division of their property <br />BECKER into two lots. Both the City Planner and the Planning <br />PROPERTY Commission have recommended approval. The Parks & <br />Recreation Commission has recommended a cash park <br />charge to be collected at the time of building permit <br />application. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 96-10-264 - APPROVING THE DIVISION OF <br />THE BECKER PROPERTY LOCATED AT 551 ALLEN AVENUE INTO <br />TWO LOTS SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS <br />OF THE CITY PLANNER AS CONTAINED IN HIS REPORT DATED <br />OCTOBER 7, 1996 <br />7 <br />
