MINUTES <br />CITY COUNCIL <br />FEBRUARY 26~ 1997 <br />by the Little Canada Fire Department. Scalze thanked <br />the Fire Department for their generosity and support of <br />these projects. <br />PROPERTY The Council reviewed the application submitted by Mr. <br />DIVISION Dick Boss for subdivision of the property located at <br />& A3SESSMENT 65 E. Bryan Street and combination with property <br />ABATEMENT - located at 57 E. Bryan Street. The Planning Commission <br />57 & 65 recommended approval of the property division/ <br />BRYAN 3TREET - combination subject to removal of the small shed which <br />DICK B038 currently straddles the lot line between the two <br />parcels. The Commission also recommended that the <br />garage which encroaches onto the Boss Road right-of-way <br />be removed at the time Boss Road is improved. <br />The City Planner pointed out that the Planning <br />Commission felt the small shed was easily moved; <br />therefore, should be relocated at this time to meet <br />setback requirements. <br />LaValle asked if the City should consider the vacation <br />of Boss Road. The City Administrator pointed out that <br />the City has utilities through this right-of-way; <br />therefore, would have to retain a utility easement. <br />Pedersen asked about adverse possession. The City <br />Attorney replied that Minnesota has no adverse <br />possession rights on public property. <br />Morelan pointed out that the lot at 57 E. Bryan Street <br />would be subdividable. Therefore, Morelan recommended <br />Boss Road right-of-way not be vacated at this time <br />unless there is a petition from the adjacent property <br />owner requesting it. <br />The City Administrator reported that Mr. Boss has <br />requested abatement of water main assessment for <br />Improvement No. 77-1 through 6. The Administrator <br />explained that no water stub was installed to the <br />property, and the property is not developable until <br />such time as Boss Road is improved or some other means <br />of access provided to the property. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 97-2-41 - APPROVING THE PROPERTY <br />DIVISION AND COMBINATION AS REQUESTED BY MR. DICK BOSS <br />SUBJECT TO DEDICATION OF 6-FOOT DRAINAGE AND UTILITY <br />EASEMENTS ON LOT LINES, SUBJECT TO THE RECOMMENDATIONS <br />2 <br />
