MINUTES <br />CITY COUNCIL <br />APRIL 23, 1997 <br />Morelan indicated tl~at l~e would like to see the installation done <br />underground. Pedersen agreed. <br />Morelan suggested that staff discuss this issue with Brooks Fiber and <br />determine ifunder~round installation is cost prohibitive. The <br />Administrator reported that Brooks Fiber has already indicated that <br />underground installation is cost prohibitive in some areas, and they would <br />like to be treated like otl~er utilities. <br />Fahey felt the Council should see some rationale or justification for an <br />overhead installation. Fahey asked if it were fair to impose a standard on <br />one company that is not imposed on another. <br />Morelan pointed out that the City's ordinance requires underground <br />utilities in new developments. Sca(ze pointed out that this was a new <br />utility. <br />The City Administrator pointed out tl~at the agreement says that all <br />installations must be underground unless the City approves an overhead <br />installation. Broolcs Fiber has indicated they would (ike some overhead <br />installations in existing areas. <br />Fahey suggested that for overhead installations a cost analysis should be <br />submitted to sllow why underground was uot feasible. Fahey stated that <br />he would support the agreement as presented under this condition. <br />However, he would not feel right penaliziu~ this utility. Fahey sug~ested <br />that Brooks Fiber develop some standards for discussion when the propose <br />to depart from the underground installation. <br />Mr. Fahey introduced tlie following resolution and moved its adoption: <br />RESOZ, UTION ND. 97-4-99 - APPROVING THE ]31200KS F713ER, <br />INC. RIGHT-OF-WAYAGREEMEN"l AS PRESENTED AND <br />AZITHORIZING TI~E MAYOR AND CYTY~IDMZNISTRATOR TO <br />EXECDTE THE AGIZEEMENT ON 73EHAI,F OF THG CITY <br />The foregoi~~g resolution was duly seconded by Pedersen. <br />Ayes (3) Fahey, Pedersen, LaValle. <br />Nays (2) Scalze, Morelan.
