This setback was <br />compliant at the time of construction, when the required rear setback was 30 feet, and is therefore <br />considered legally non-conforming under current standards. As a result of the boundary adjustment, <br />the rear setback would be reduced to 30 feet. Because the current zoning code now requires a <br />minimum rear setback of 40 feet, a variance of 10 feet is needed to accommodate the proposed <br />configuration. <br /> <br />The proposed boundary line adjustment also affects 50 County Road C East by bringing the property <br />into full compliance with the City’s current rear setback standard. The existing principal structure <br />currently has a rear setback of 35.5 feet, which does not meet the required 40-foot minimum. <br />Following the adjustment, the rear setback would increase to 43.5 feet, eliminating the non-conformity <br />and aligning the property with current zoning requirements. <br /> <br />Provided that the City Council approve the variances, Staff is supportive of the minor subdivision. <br /> <br />Rear Setback Variance <br />1. The request is in harmony with the purposes and intent of this ordinance <br />Staff believes that this criterion is met for the rear setback variance request. Rear setbacks are designed <br />to ensure that property owners have natural areas behind their homes and an adequate amount of <br />separation. The homes were both developed legally under code, with 50 County Road C East <br />constructed more recently in 2004. <br /> <br />2. The variance is consistent with the Comprehensive Plan.
