MINUTES
CITY COUNCIL
AUGUST 27, 1997
consensus was that they would not since Mr. Wahiber~'s leavin~ in the
morning at 7 A.M. is no different than anyone else leaving for work.
Fahey asked if there was anyone from the general public interested in
commenting on this matter.
Ray Buchholz, 120 E. Lake Street, reported that he lives in the house east
ofthe Wahiberg's. Buchholz pointed out that the property is zoned
residential. Buchholz indicated that the Wahlberg's have had employees
at their property as late as 11 P.M. picking up tools. Buchholz also
indicated that when the Wahlber~'s asked for a permit to raise the garage,
there was no indication that they would be operating a business from their
property.
Fahey pointed out that the 1995 Planner's report references the home
occupation. At that time the Wahlberg's applied for a variance to allow
the outdoor storage of their truck. The variance was denied, and the
Wahlberg's raised the garage so that the truck could be stored in it.
Buchholz reported that the Wahlber~'s have had employees from the very
beginning. Buchholz also reported that LJPS delivers to the Wahlberg
home 2 or 3 times per day and there is a delivery every Saturday.
Buchholz reported that sometimes a semi truck delivers large tool boxes to
the Wahlberg home.
Fahey reviewed the letter submitted by the Wahlberg's from Matco which
indicated that the large tool boxes are delivered by moving vans.
LaValle asked Harold Feickert for his input on the matter. Feickert
pointed out that his house is located to the north of the Wahlberg home.
Feickert reported that he hears no noise from the home occupation, and
indicated that he had hoped the issue could be worked out between
neighbors. Feickert pointed out that he runs a business from his home.
Scalze asked Feickert whether or not he had employees, which Feickert
indicated he did although they seldom come to his home.
LaValle felt the situation seemed to be a problem between neighbors.
LaValle pointed out that there appeared to be a lot of buffer between the
Buchholz and Wahlberg homes. Buchholz disa~reed.
Scalze felt the issue was how far the City al(owed a home occupation to go
and questioned allowing the dispatching of employees from a house.
