MINUTES <br />CITY COUNCIL <br />SEPTEMBER 10, 1997 <br />pointed out that he prepared an ordinance amendment which reflects the <br />State Statute prohibiting cigarette vending machines in establishments in <br />which minors are allowed. The Attorney further explained that another <br />issue is the provision in State Statutesthat regulatory agencies provide an <br />alternative penalty system for minors violating tobacco ordinances. The <br />Attorney indicated that he was not too sure just what this provision meant, <br />and would prefer not to include it in the City's ordinance. The third issue <br />is relative to the sale of tobacco products by self-service. The City's <br />present ordinance prohibits self-service sales exceptin cartons. It also <br />appears that the FDA will prohibit all self-service, so an amendment <br />would probably not be necessary at this time. <br />Given the complexities of the Statute revisions and the effect pending <br />FDA regulations may have on the issue, it was the consensus of the <br />Council to table action on this matter. <br />Mr. LaValle introduced the followin~ resolution and moved its adoption: <br />RESOI,UTION NO. 97-9-213 - TAI3I.ING ACTION ON TOI3ACC0 <br />ORDINANCE REVLSZONS AS DIb'CIISSED BY THE CITY CODNCIL <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4) LaValle, Morelan, Pedersen, Scalze. <br />Nays (0). Resolution declared adopted. <br />CLOSED The City Attorney requested that the Council call for a closed session <br />SESSION followin~ this meeting to discuss the Valley Paving litigation.
