MINUTES <br />CITY COUNCIL <br />SEPTEMBER 24, 1997 <br />Upon motion by LaValle, seconded by Morelan, the public hearing was <br />closed. <br />The City Planner noted that the applicant has submitted a revised survey <br />that provided for a 30-foot rear yard setback for the existing house. Scalze <br />noted that the Park & Recreation Commission has recommended cash in <br />lieu of land <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 97-9-225 - APPROVING THE DI vISION OF 45 <br />W. DEMONT AVENUE INTO TWO SINGLE-FAMILYLOTS AS <br />SHOWN ON THE REVISED SURVEYSUBMITTED BYMR. <br />ROBERT JOHNSON SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITYPLANNER AS OUTLINED IN <br />HIS REPORT DATED SEPTEMBER 9, I997 AND SUBJECT TO <br />COMPLIANCE WITH THE RECOMMENDATION OF THE PARK & <br />RECREATION COMMISSION FOR A CASH PARK CHARGE <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) Scalze, LaValle, Morelan, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />CONDITIONAL Fahey opened the public hearing to consider an application for a <br />USE PERMIT- Conditional Use Permit to allow expansion of a non-conforming <br />EXPAND single-family house located at 34 E. Owasso Blvd. Fahey reviewed <br />NON- the recommendation of the Planning Commission limiting the expansion <br />CONFORMING to not mare than 500 square feet on the first floor of the house and <br />HOUSE - allowing the house to be raised to provide an 8-foot clearance to the <br />LUNZER basement ceiling. <br />Alicia Lunzer, owner of 34 E. Owasso Blvd., indicated that the <br />recommendation of the Planning Commission was acceptable. Raising the <br />house would allow the basement to finished. <br />Fahey felt that given the character of the neighborhood, the <br />recommendation of the Planning Commission was reasonable. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by LaValle, seconded by Scalze, the public hearing was <br />closed. <br />
