MINUTES <br />CITY COUNCIL <br />MARCH 25, 1998 <br />Fahey pointed out that the City entered into an agreement with Brooks <br />Fiber which called for underground installation. After that agreement was <br />signed, Brooks Fiber requested an overhead installation in some areas. <br />The Council required compliance with the a~reement. Fahey also pointed <br />out that the Brooks Fiber line which was installed throu~h Little Canada <br />was a loop of a metropolitan line and was not serving Little Canada <br />residents. <br />Fahey further noted that this City has not required existing utilities with <br />overhead installations to bury their lines. However, the City does have an <br />ordinance which requires new utility installations to be buried, and the <br />requiring the Cable TV lines to be buried would be consistent with that <br />philosophy. <br />The City Administrator pointed out that a franchise renewal is the time <br />the City can impose this type of requirement. The Administrator also <br />pointed out that when Little Canada Road is reconstructed, the City will <br />request that NSP replace all overhead lines with underground. Morelan <br />agreed that now is the time to look at the issue. <br />Fahey indicated that his initial reaction is that it is unreasonable to require <br />the cable company to bury all their lines when other utilities are not being <br />required to do the same thing. The Brooks Fiber line was one that did not <br />serve the residents of the City.
