1VIINUTES <br />CITY COUNCIL <br />JUN~ 24, 1998 <br />Morelan poinYed out Yhat the ~row~d will need to be disiUpted to install <br />new cable. Morelan asked if the City's rights-of-way ordinance requires <br />the removal of abando~~ed wires. <br />Fahey pointed out tl~e diffc~ilty of getting accurate locates on utilities <br />when abandoned wires are left in the ground. <br />Gibbs repoirted that they are not expecting to tind much damaged cable, <br />and feel it would be too disruptive to remove any they do find. <br />Tim Gavin, Media One, reported that the cable that is out there is active <br />and will continue to be used. To avoid additional disruption Media One <br />would leave any cable wl~ich would need to be re}~laced in tlie ~round. <br />IIowever, if the City lils an ordinance requiring that abandoned lines must <br />be removed, then they will be removed. <br />The City Administrator reported th~t Public Worl<s would recommend that <br />any abandoned wires within the public ri~hts-of-way be removed. <br />Leaving these lines in place can cause false locates. <br />Gibbs sug~ested that Media One worl< with City staff' on this issue. Gibbs <br />also indicated that removing abandoned undergrouud clble raises some <br />safety concerns. <br />I'ahey asked ifthis issue is addressed in the City's ri~hts-of-way <br />ordinance. The City Attorney reported thlt the ri~hts-oti-way ordinance <br />does provide co~~trol of the issue. <br />Gibbs stated that he does not dis~~ree that the rights-of-way ordinance is <br />the vehicle to address this issue. <br />Fahey asked ifMedil One wouid dispute the City's auChoriYy Yo require all <br />abat~doned uti(ity lines to be removed. Gibbs replied that Media One <br />would not disp~ite this authority if it were applied to all providers. Gibbs <br />stated thlt Media Oi~e would like their safety people to discuss this issue <br />since there may be more of a safety risk to take abandoned lines out than <br />to le~tve Them in. <br />Morelan asked the relatio~~ship between Media One and Meredith Cable. <br />Gibbs replied that Media One is the new name for the same company. <br />Two years ago Continental Cable Vision purchasetl Meredith Cable. U.S. <br />West then purchased Continental Cable Vision. Since a company cannot <br />provide both clble service and telephone seivice in the same area, and <br />U.S. West felt tl~e media company did uot fiC, it planned to divest itself of <br />IS <br />
