MINUTES <br />CITY COUNCIL <br />OCTOBER 28, 1998 <br />Scalze asked about the Williams Bros. Pipeline issue. Kimmes replied <br />that his abstract does not show the existence of a Williams Bros. Pipeline <br />easement on the property. Kimmes thought that that easement existed in <br />the Highway 36 right-of-way area. <br />Fahey suggested that the City Attorney verify whether or not there was <br />such an easement on the Kimmes property. <br />Scalze asked about the easement which is needed from Brian Ducharme. <br />Morelan asked if it was necessary for Kimmes to do anything with the <br />Ducharme property. Morelan asked if the swale was necessary. Kimmes <br />replied that he would need permission from Kimmes to put construct a <br />swale. Morelan pointed out that the Engineer's report says that a swale <br />would be a better approach to resolving the drainage issue. However, it <br />does not look like a swale is necessary given that the run-off onto the <br />Ducharme property is not being increased. Morelan asked that this issue <br />be clarified. <br />Fahey suggested that action on the preliminary plat be tabled for two <br />weeks to give the City Attorney an opportunity to research the questions <br />posed to him as well as to give the City Engineer an opportunity to <br />respond. <br />Kimmes agreed. <br />Scalze noted that the Council needs to see somethin~ from Brian <br />Ducharme showing that he agrees to the swale, as well as see a <br />determination on the location of the Williams Bros. Pipeline easement. <br />Fahey encouraged Mr. Kimmes to consider a four-lot development. <br />The City Administrator recommended that the matter be tabled until the <br />second meeting in November in order for staff to have an opportunity to <br />respond to the questions raised by Council. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOI, UTION NO. 98-IO-256 - CONTINUING THE PU73LIC <br />HEARING FOR THE GII.ANDERI ADDITION PREI,IMINARY <br />PLAT UNTII, THE NOVEMI3ER 25, 1998 RECUI,AR COUNCII. <br />MEETING <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Fahey, Scalze, Morelan. <br />Nays (0). Resolution declared adopted. <br />
