MINUTES <br />CITY COUNCIL <br />JANUARY 27, 1999 <br />ORDINANCE NO. 481- AMENDING SECTION 902. 010 OF <br />THE LITTLE CANADA ZONINC ORDINANCE REI.ATING <br />TO THE DEFINITION OF SETI3ACKS <br />The foregoing ordinance was duly seconded by Pedersen. <br />Ayes (5) Morelan, Pedersen, Fahey, LaValle, Scalze. <br />Nays (0). Resolution declared adopted. <br />FRATTALONE The City Administrator reported that he and the City Attorney have <br />RECYCLING been reviewing the facts relative to the Frattalone development <br />OPERATION agreement for recycling operation on Country Drive and the means <br />which should be used for allowin~ that operation to continue. <br />Based on that review, it is their recommendation that an interim <br />use zoning district be created and a license fee established. The <br />Administrator requested direction from the Council to prepare a <br />detailed report and proposed ordinance establishing the interim use <br />district. This would then be submitted to the Council for review <br />and adoption. <br />Morelan pointed out that if an interim use zoning district is created <br />then any property owner in the City could apply for rezoning to <br />this district. <br />The City Attorney replied that this is correct. He also indicated <br />that the interim use district would be established in such a way as <br />to have a termination date. <br />Scalze asked how a termination date could be enforced. <br />The City Attorney reported that the termination date would be <br />a~reed to by the developer. <br />Morelan asked if there were any other alternatives for addressing <br />the recycling operation or if this was the most viable option. The <br />Administrator felt this was the most viable option. <br />Fahey suggested that another option would be to make recycling a <br />permitted use and allow it to continue indefinitely subject to a <br />license fee. <br />The City Attorney reported that he and the City Administrator have <br />not vet completed their review of the facts as to the exact status of <br />the existing use.
