MINUTES CITY COUNCIL JANUARY 27, 1999 ORDINANCE NO. 481- AMENDING SECTION 902. 010 OF THE LITTLE CANADA ZONINC ORDINANCE REI.ATING TO THE DEFINITION OF SETI3ACKS The foregoing ordinance was duly seconded by Pedersen. Ayes (5) Morelan, Pedersen, Fahey, LaValle, Scalze. Nays (0). Resolution declared adopted. FRATTALONE The City Administrator reported that he and the City Attorney have RECYCLING been reviewing the facts relative to the Frattalone development OPERATION agreement for recycling operation on Country Drive and the means which should be used for allowin~ that operation to continue. Based on that review, it is their recommendation that an interim use zoning district be created and a license fee established. The Administrator requested direction from the Council to prepare a detailed report and proposed ordinance establishing the interim use district. This would then be submitted to the Council for review and adoption. Morelan pointed out that if an interim use zoning district is created then any property owner in the City could apply for rezoning to this district. The City Attorney replied that this is correct. He also indicated that the interim use district would be established in such a way as to have a termination date. Scalze asked how a termination date could be enforced. The City Attorney reported that the termination date would be a~reed to by the developer. Morelan asked if there were any other alternatives for addressing the recycling operation or if this was the most viable option. The Administrator felt this was the most viable option. Fahey suggested that another option would be to make recycling a permitted use and allow it to continue indefinitely subject to a license fee. The City Attorney reported that he and the City Administrator have not vet completed their review of the facts as to the exact status of the existing use. However, it doesn't appear that the business is 14
