MINUTES <br />CITY COUNCIL <br />MAY 25, 1999 <br />Thul reported that an addition was added to the original garage in 1985 at <br />which time a CUP was ~ranted for the additional garage space. Thul <br />pointed out that there are three acres of unbuildable property behind his. <br />Therefore, his request for a rear yard setback variance will not affect his <br />neighbors. <br />Scalze felt that the issue was converting detached garages into living space <br />and considering that space as part of the home because it is attached via a <br />covered walkway. <br />Pedersen indicated that the ability to attach two structures via a covered <br />passageway and the result being considered one structure made him <br />uneasy. <br />Thul indicated that the Code allows the use of a covered passageway to <br />attached two structures. <br />Scalze suggested that an option would be to put the addition between the <br />house and the ~arage. <br />Thul reported that he is short three bedrooms. He also noted that he has <br />gone ahead and installed the footings for the addition to his house. <br />Scalze asked if Thul applied for building permits a year ago when he <br />discussed his concept with the Building Official and City Planner. Thul <br />reported that he did not. However, he did discuss the ordinance relative to <br />covered passa~eways with the City Planner, who indicated there would be <br />no problem. <br />Scalze asked if Thul had a buildin~ permit for the addition he is proposing. <br />Thul reported that that building permit is pending. However, he was <br />issued a permit for the footings provided that if the Variance was not <br />approved, the addition to his house would be living space and not garage <br />space. Thul indicated that converting this to living space may affect the <br />appraised value of the work he is doing, which may affect his loan for the <br />project. <br />Fahey indicated felt there was no hardship present to justify the variance, <br />and suggested that perhaps the property is becoming over-built. Scalze <br />felt grantin~ the variance would be setting a major precedent in the City <br />and would result in a major deviation from the Code. Fahey cited the <br />Battista request as a comparison with what Mr. Thul is proposing. <br />il <br />
