MINUTES
CITY COUNCIL
JUNE 8, 1999
TfIERESA In honor of the receipt of the Girl Scout Silver Award, Mayor Fahey
BELLO & and Members of the City Council declared Tuesday, June 8, 1999 as
KAT1E Theresa Bellow and Katie Kramarczuk Day in the City of Little Canada.
KRAMARCZUK Mayor Fahey and the Council congratulated Theresa and Katie on their
DAY accomplishment.
FRA-DOR Mayor Fahey opened the public hearing to consider the Interim Use
DEVELOPMENT Permit for aggregate materials stockpiling and recycling at Fra-Dor
AGREEMENT & located at 3137 Country Drive.
LICENSE FEE
ORDINANCE The City Administrator reviewed the fourth amendment of the Frattalone
Development Agreement which addresses the terms and conditions for
the aggregate materials stockpiling and recycling as an interim use. The
Administrator noted that the amendment as proposed would require Yhe
posting of a$500,000 bond over the ten-year period the interim use would
be allowed. This bond would ensure that stockpiles would be removed
and the property restored at the expiration of the interim use.
Fahey questioned the necessity of requiring that the full $500,000 be
posted over the entire ten-year period. Morelan asked how the $500,000
figure was arrived at.
The Administrator reported that Frattalone estimated the cost of removal
of the stockpiles at $320,000. Given that removal would be ten years out,
the estimate was increased to $500,000. The Administrator indicated that
he and Frattalone discussed the option of postin~; a smaller bond during
the initial years of the interim use permit, with that amount to increase at
perhaps the 8-year mark.
Morelan asked if there was discussion about shortening the term of the
interim use permit. The Administrator replied that there was not given
that the ten-year term was a key issue in earlier discussions.
Frattalone agreed that the time period for the interim use permit was a key
issue and indicated that he is agreeable to a ten-year time period.
However, he did have a concern with posting a$500,000 bond for the
entire ten-year period, pointing out that this ties up $500,000 of his
bondability over the next ten years. Frattalone suggested a$200,000 bond
now with the amount to increase to $500,000 at year 8. Frattalone pointed
out that the bond will be critical later in the term of the interim use period.
The Administrator pointed out that if the bond amount is not increased at
year 8, the City could pull the interim permit. However, it would then be
faced with the cost of removal of the stockpiles and the $200,000 bond
