MINUTES <br />CITY COUNCIL <br />NOVEMBER 10, 1999 <br />ZONING ADMINISTRATOR AS OUTLINED IN HER REPORT <br />DATED OCTOBER 7, 1999 SUI3JECT TO COMMON OWNERSHIP <br />OF THIS PROPERTY WITH THAT OF 3164 RYAN LANE 13EING <br />MAINT.9INED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Fahey, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />CUP - Mayor Fahey opened the public hearing to consider the application for <br />3101 SPRUCE Conditional Use Permit for open and outdoor storage of materials and <br />STREET - equipment as an accessory use at 3101 Spruce Street as requested by Mr. <br />LEE ROSSOW Lee Rossow. The Planning Commission has recommended approval of <br /> the CUP. <br />The Zoning Administrator pointed out that there are a total of 94 parking <br />spaces required for this property. Of these spaces 11 are for the office use, <br />75 are for bus driver employees, and 8 are for bus repair employees. <br />The Zoning Administrator pointed out that there are issues related to the <br />landscape structures that Mr. Rossow has constructed in the right-of-way. <br />One relates to the structure around an existing fire hydrant, and Mr. <br />Rossow has agreed to move the structure and level the grade so that there <br />is a four-foot area around the hydrant for easy access to it. He has also <br />agreed to install two bollards near the hydrant to protect it. <br />Scalze expressed concern about having anything in the public right-of-way <br />other than grass. Scalze asked if any of Mr. Rossow's required parking <br />was located in the right-of-way. <br />The Zoning Administrator reported that the Code requires a 15-foot <br />setback from the surface of the street as well as a 5-foot setback from the <br />property line. Mr. Rossow has installed the landscape stiuctures with <br />green area within those structures adjacent to the surface of the street <br />rather than just grass. <br />Morelan asked if required parking spaces were on Mr. Rossow's property <br />or on the right-of-way. <br />The Zoning Administrator reported that she measured from the road <br />surface 15 feet back, and parking was 15 feet away from the surface of the <br />street. However, she was not sure where the property line was located in <br />order to determine whether or not required parking is in the right-of-way <br />or on Mr. Rossow's property. <br />
