STAFF REPORT <br />1 <br />TO: Mayor Fischer and Members of the Little Canada City Council <br />FROM: Ben Harrington, AICP, Community Development Director <br />DATE: July 09, 2025 <br />RE: Addendum - Special Home Occupation Permit – Karen Hildebrand & Andrew Hightower <br />–2612 Edgerton Street Little Canada MN, 55117 <br />ACTIONS TO BE CONSIDERED <br />Approve with Conditions/Deny a Special Home Occupation Permit for 2612 Edgerton Street Little <br />Canada, MN 55117. <br />ADDENDUM/BACKGROUND <br />This addendum supplements the original staff report dated June 23, 2025, and reflects direction and <br />amendments requested by the City Council during its discussion of the Special Home Occupation <br />Permit application for 2612 Edgerton Street. <br />Two points of clarification raised at the last meeting <br />1.Is the City liable for injury/accidents that may happen because of the Special Home <br />Occupation Permit Issuance? <br />The City Attorney has advised that the city is only liable to process the land use permit request <br />fairly and reasonably. The City’s liability related to a land use permit would be if the City <br />arbitrarily or capriciously approved or denied the permit. The City is not liable for injuries or <br />accidents that may occur because of activities conducted on the property, even when permitted by <br />the City permit. <br />2.Could the City Add Conditions Related to the Bodies of Water Used by The Applicant? <br />While the City does not have jurisdiction over connected water bodies outside of its municipal <br />boundaries, the City may include reasonable conditions to mitigate impacts on Lake Gervais <br />caused by intensive use. In consultation with the City Attorney, staff drafted Condition 10 in the <br />revised list below, which requires that the applicant ensure their activities are “reasonably <br />distributed across the connected lake system.” <br />REQUEST <br />The City Council is being asked to consider several deviations from the standard home occupation <br />requirements outlined in the City’s Zoning Code. The Council has full discretion to approve, deny, or <br />modify any portion of the request based on staff findings and public testimony. Staff offers the <br />following summary of the proposed deviations:
