3 <br />2. This Special Home Occupation Permit shall be valid for one (1) year. Renewal shall not be <br />presumed and will be subject to review by the Zoning Administrator. In the event of written <br />complaints, observed violations, or a change in site conditions, the Community Development <br />Director may refer the renewal to the City Council for full review under the original approval <br />process. <br /> <br />3. This permit is non-transferable and does not run with the land. It is granted solely to the current <br />property owners and for the approved use only. <br /> <br />4. Failure to comply with any condition of this permit may result in revocation by the City <br />Council. <br /> <br />Specific Conditions <br />5. Practices shall occur no more than once per day, for a maximum of two hours, between 4:30 <br />PM and 6:00 PM during the ISD 623 school year, and from 8:00 AM to 10:00 AM during <br />summer break. <br /> <br />6. No more than 25 individuals may be involved in the home occupation at any time, whether on <br />the property, on the adjacent shoreline, or on the lake. This includes participants, coaches, and <br />any other affiliated persons. <br /> <br />7. A formal written agreement must be executed between Lake Phalen Rowing and the City of <br />Little Canada for use of the parking lot at 515 Little Canada Road East. The agreement shall <br />include indemnification language and name the City as an additional insured unless otherwise <br />advised by the City Attorney. It shall be subject to review and approval by the City Council. <br /> <br />8. Parking by Lake Phalen Rowing participants, coaches, or visitors shall not occur on Edgerton <br />Street or Schletty Drive. <br /> <br />9. To protect the general welfare of the surrounding neighborhood, the use of megaphones, <br />bullhorns, amplifiers, or any other voice amplification devices is prohibited in connection with <br />the home occupation. <br /> <br />10. To minimize the concentration of lake use directly adjacent to the property and thereby <br />minimize the impact for adjacent property owners and to promote equitable access for other <br />users, the applicant shall ensure that on-water activity related to the home occupation is <br />reasonably distributed across the connected lake system. <br /> <br />11. The applicant shall designate a primary point of contact for the City, the Lake Gervais <br />Association, and neighboring residents regarding the permitted activity. Contact information <br />shall be provided to City staff and updated as needed. <br /> <br />These conditions are intended to allow the approved activity to proceed in a manner that is compatible <br />with neighborhood expectations and manageable under the City’s enforcement capabilities.
