Hanson <br /> www. ci.little-Canada. mn. us <br /> MEMORANDUM <br /> TO: Mayor Blcsener and Members of the City Council <br /> FROM: Joel Hanson, City Administrator <br /> DATE: August 25, 2009 <br /> RE: Cooperative Construction Agreement with MN DOT <br /> Little Canada Road/35E Bridge Railing <br /> Attached is an Agreement with MN DOT addressing their share of costs toward <br /> replacement of the little Canada Road/35E Bridge railing. MN DOT has agreed to <br /> participate in the amount of $50,000 toward this project. Total estimated project costs are <br /> $114,000. The City is responsible for the balance of the costs, with funding to come <br /> from the Capital Improvement Fund. <br /> Staff has reviewed the Agreement and has identified issues of concern. The first is that <br /> MN DOT is proposing that the City be responsible for the on-going maintenance of the <br /> bridge railing. It is staffls position that MN DOT is responsible for this railing and the <br /> railing meets their standard specs. Secondly, there is a short timeline for completion date <br /> which could impact the bid prices. City staff recommends we bid an alternate completion <br /> date into next year to ensure a more favorable bid price can be obtained. And, finally, the <br /> construction agreement contains standard language addressing issues of liability and <br /> responsibility that do not apply in a project of this nature. <br /> City staff is continuing to work with MN DOT to resolve the issues above, and will bring <br /> this Agreement back to the Council for action as appropriate. In the meantime, we <br /> wanted to confirm your position on these issues. <br /> <br />
