This <br /> project will encompass other improvements along Rice Street from County Road B to B2. As part of this process, the <br /> County needs to complete aright-of-way plan. In this case, iwo properties require our involvement. <br /> The first parcel is the former Oasis site that is being replatted as part of the Melancon Plat. As you will recall, we have not <br /> recorded this plat yet due to a title issue involving MnDot's turnback of Viking Drive to the City back in 1994. The City <br /> Attorney has commenced a quiet title action that will take until the end of the year to complete. Ramsey County needs a <br /> permanent easement of 624 square feet for the proposed sidewalk (about five feet in width over a good portion of the <br /> property -see map attached) and a temporary easement of 1099 square feet. (That goes away when the road project is <br /> done.) They could appraise the property and pay us for the easement or we could dedicate it to the County. (If a private <br /> property owner were involved, we would likely make them dedicate it to facilitate the sidewalk system.) If we agree to <br /> dedicate the easement, we save the project the cost of the appraisals and the easement. <br /> We would also need to enter into an agreement to do this to provide the County with evidence of site control by April <br /> versus having to pay to redo the plat. <br /> The second parcel is the Bakery Outlet. They need about 10 feet off of the west side for sidewalk and additional footage <br /> along the south side (62) for sidewalk. Given our commitment to buy the site as part of the St. Jude TIF project, I told the <br /> County it would not make sense to commission another appraisal and pay the Bakery Outlet owners money for these <br /> easements when we are committed to taking down the site under our development agreement. Two issues arise. The <br /> first is we would need to commit to site control by early April if the Bridge project proceeds next year. The second is we <br /> would need to donate the easements as indicated on the attached drawing. Given we want sidewalks in this area, it would <br /> seem to make sense to donate the easements rather than incurring additional expense for separate appraisals. <br /> The County would like to know our position on these two parcels so they can finalize their right-of-way plan. <br /> This will be an addition to tomorrow's agenda. <br /> JH <br /> .;y~; <br /> RICE <br /> ENTS 2009090815 <br /> 1 <br /> <br />
