During this process, it was <br /> noticed that the language in the ordinance relating to simple subdivisions created a <br /> threshold whereby a lot split into two lots from one parcel qualified for this treatment. <br /> The creation of three or more lots would require a plat. <br /> It was observed that over the years, the threshold has been three lots, and the timing or <br /> process for the change to the two-lot threshold in the code is not clear. Since the three- <br /> lotthreshold has been the predominant standard, this amendment is proposed to <br /> change the code language back to allow simple subdivisions that create no more than <br /> three lots, thus requiring plats for four or more lots. <br /> This has become a more important issue since the City's R-1 zoning district changes <br /> based on plat status and timing. Simple subdivisions are permitted to utilize the older <br /> 10,000 square foot lot size, whereas newly platted lots must now be 11,000 square feet <br /> in area. <br /> If approved, the ordinance will be changed to read as follows: <br /> 1001.060. EXCEPTIONS. When requesting a subdivision, if the following condition or conditions <br /> exist, the City Administrator shall deem the request to be a "simple subdivision" and exempt the <br /> subdivider from certain procedural provisions as directed in this section. <br /> A. In the case of a request to divide a lot where the division is to permit the adding of a parcel <br /> of land to an abutting lot or to create three (3) lots and the newly created property lines will <br /> not cause the other remaining portion of the lots, or any structures within the subdivision, to <br /> be in violation with this Ordinance or the 'Coning Ordinance, then the City Administrator <br /> <br />
