<br /> MINUTES <br /> <br /> CITY COiINCIL <br /> OCTOBER 28, 2009 <br /> With regard to the doors that need to be added to the easterly building, <br /> McGraw felt that there should be a clear definition of the types of doors <br /> that would be acceptable. The same applies to the required fencing. <br /> McGraw indicated that he was leaning toward not extending the deadline <br /> given the past history with this property. However, he wants to he sure <br /> that the property owner has a clear understanding of the requirements and <br /> that there is no wiggle room. <br /> Blesener asked if the property owner understood flee City's requirements <br /> for compliance. Mary Fasching replied that she did. Blesener asked if <br /> Ms. Fasching was willing to meet with City staff to review the <br /> requirements in detail. She replied that she was, and Schivone indicated <br /> that he would be at that meeting as well. Blesener suggested that this <br /> meeting occur within three to four business days. <br /> Roger Stanke, 209 Ryan Drive, reported that he has spoken with 90% of <br /> the property owners in Ryan Industrial Park and they want this PLID <br /> Permit revoked this evening. Stanke spoke to the non-compliance of this <br /> property for the past 9 ye~u•s. Stanke also expressed concern that the fence <br /> on the property is not straight and is too close to Ryan Drive. Stanke <br /> further reported that there was a water valve on the Costanzo property that <br /> controlled the water line serving some of the properties to the west. He <br /> was concerned about access to this valve. Stanke asked what will happen <br /> if the property is not brought into compliance and the City revokes the <br /> PUD Permit. <br /> The City Attorney replied that the building would be red-tagged and the <br /> businesses on the property would not be allowed to operate. The Attorney <br /> also pointed out that access to the water valve would be a health and safety <br /> issue; therefore, the City would be aggressive about requiring access to <br /> this valve. <br /> The City Administrator indicated that City staff will look at the issue of <br /> the Constanzo fence and try to determine when it was installed. <br /> Mr. Blesener introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2009-70-259 -CONTINUING THE PUBLIC <br /> HEARING FOR CONSIDERATION OF REVOCATION OF PUD <br /> PERMIT FOR 3151 COUNTRYDRIVE UNTIL WEDNESDAY, <br /> DECEMBER 16, 2009 AT 7:30 P.M. CONDITIONED UPON THE <br /> PROPERTY OWNER MEETING WITH CITY STAFF WITHIN FOUR <br /> BUSINESS DAYS TO OBTAINA CLEAR UNDERSTANDING OF <br /> WHAT TFIE CITY IS REQUIRING OF THEM TO COMPLY WITH <br /> THEIR PUD PERMIT, AND WITH THE UNDERSTANDING THAT <br /> COMPLIANCE MUST BE ACHIEVED BYNOVEMBER 30, 2009 <br /> 12 <br /> <br />
