MINUTES CITY COiJNCIL OCTOBER 28, 2009 FINE coordinating this ordinance with the Ramsey Co~mty Sheriff's ORllINANCE Department and the other contracting cities. The City Administrator indicated that the goal of the contracting group is to have this ordinance finalized by January 1, 2010. I-Ie noted that the Sheriff's Deparbnent has agreed to collect the fines and provide credits back to the contracting cities. The main issue to resolve with the issue of the hea~•ing officer and the frequency that this officer would be available. LITTLE The City Administrator reviewed the contract between the City a~~d MN CANAllA DOT for the replacement of the Little Canada Road bridge railing and the ROAD painting of the parapets. The Adminish•ator reported that City staff has BRIDGE been working with MN DOT to ensure that future bridge railing RAIL maintenance is the responsibility of MN DOT. When City staff pointed PROJECT out to MN DO"h that the agreement did not address maintenance; they indicated that the 1987 agreement did and would apply. The Administrator noted that in reviewing the 1987 agreement, he found that maintenance of these items was not addressed. The Administrator repoi•ced that MN DOT has indicated that they would not modify the agreement; however, they did submit a letter dated October 22, 2009 indicating their responsibility for railing maintenance. The Administrator reported that the cost of the railing replacement and parapet painting will be split equally between the City and MN DOT with MN DOT's contribution capped at $50,000. The City's cost is MSA eligible. He noted that MN DOT has received only one bid for this work. Given that the work would not be done until spring and in order to ensure that the work is done at a competitive price, the Administrator recommended that the bid be rejected and the work rebid in the spring. The Administrator indicated that the City Engineer has discussed the bid timing wit9i some contractors, and agrees that additional bids would likely be received at that time. Mr. McGraw introduced the following resolution and moved its adoption: RESOLUTION NO. 2009-10-2G1-APPROVING THE AGREEMENT WITH MN DOT FOR LITTLE CANADA ROAD BRIDGE RAILING REPLACEMENT AND PARAPET PAINTING AND AUTHORIZING THE MAYOR AND CITYADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY The foregoing resolution was duly seconded by Blesener.
