The City Administrator <br /> indicated that the goal of the contracting group is to have this ordinance <br /> finalized by January 1, 2010. I-Ie noted that the Sheriff's Deparbnent has <br /> agreed to collect the fines and provide credits back to the contracting <br /> cities. The main issue to resolve with the issue of the hea~•ing officer and <br /> the frequency that this officer would be available. <br /> LITTLE The City Administrator reviewed the contract between the City a~~d MN <br /> CANAllA DOT for the replacement of the Little Canada Road bridge railing and the <br /> ROAD painting of the parapets. The Adminish•ator reported that City staff has <br /> BRIDGE been working with MN DOT to ensure that future bridge railing <br /> RAIL maintenance is the responsibility of MN DOT. When City staff pointed <br /> PROJECT out to MN DO"h that the agreement did not address maintenance; they <br /> indicated that the 1987 agreement did and would apply. The <br /> Administrator noted that in reviewing the 1987 agreement, he found that <br /> maintenance of these items was not addressed. The Administrator <br /> repoi•ced that MN DOT has indicated that they would not modify the <br /> agreement; however, they did submit a letter dated October 22, 2009 <br /> indicating their responsibility for railing maintenance. <br /> The Administrator reported that the cost of the railing replacement and <br /> parapet painting will be split equally between the City and MN DOT with <br /> MN DOT's contribution capped at $50,000. The City's cost is MSA <br /> eligible. He noted that MN DOT has received only one bid for this work. <br /> Given that the work would not be done until spring and in order to ensure <br /> that the work is done at a competitive price, the Administrator <br /> recommended that the bid be rejected and the work rebid in the spring. <br /> The Administrator indicated that the City Engineer has discussed the bid <br /> timing wit9i some contractors, and agrees that additional bids would likely <br /> be received at that time. <br /> Mr. McGraw introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2009-10-2G1-APPROVING THE AGREEMENT <br /> WITH MN DOT FOR LITTLE CANADA ROAD BRIDGE RAILING <br /> REPLACEMENT AND PARAPET PAINTING AND AUTHORIZING <br /> THE MAYOR AND CITYADMINISTRATOR TO EXECUTE THE <br /> AGREEMENT ON BEHALF OF THE CITY <br /> The foregoing resolution was duly seconded by Blesener. <br /> Ayes (5). <br /> Nays (0).
