<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> JANUARY 27, 2010 <br /> Himmelbach noted the dumping that occurred on his property in 1976 <br /> when the City approved a building permit for Bill Richie. Blesener noted <br /> that Hanson Builders have indicated they will clean up the site. <br /> Himmelbach again stated that he is unsure about his lack of action on the <br /> artifacts and stated that he may be trying to see what the City Council will <br /> do without his action. Himmelbach felt that the archeological significance <br /> of the area is a matter of international interest. He stated that he would <br /> like the City to take responsibility. Blesener noted that the City has taken <br /> Mr. Himmelbach's word that the artifacts exist as they have never been <br /> seen. Blesener asked that Himmelbach find the artifacts and take them <br /> somewhere for evaluation. <br /> McGraw noted that this is the third time since he has been on the Council <br /> that Mr. Himmelbach has raised this issue, and indicated that the very first <br /> time Mr. Himmelbach indicated that he would take the artifacts in for <br /> evaluation. McGraw stated that unless these artifacts are authenticated, he <br /> will not holdup the Gervais Woods development. McGraw noted that Mr. <br /> Himmelbach has had a couple of years since the Richie Place plat was <br /> proposed to bring the artifacts in. McGraw also noted that there has been <br /> no other indication from any agencies or the City's Historical Society that <br /> substantiates Mr. Himmelbach's claims. <br /> Himmelbach felt that the area of significance is where the stub road is <br /> proposed in the Gervais Woods plat. He indicated that he is asking the <br /> city to recognize that it may not be possible to extend that stub road for the <br /> reasons he has stated. Himmelbach stated that he recognizes that the <br /> burden of proof is on him, and he is OK with that. He wanted the Council <br /> to be aware that within the next couple of months some agency may <br /> sequester the area and close down the proposed stub road. <br /> Blesener noted that the Counci] has the Gervais Woods Preliminary Plat <br /> before it this evening. Final Plat approval is likely to occur in March. <br /> Blesener suggested that Mr. Himmelbach pursue his issues before that <br /> time. McGraw noted that the onus of proof is on Mr. Iimmelbach and <br /> that he should get the artifacts to the appropriate agencies before Final Plat <br /> approval occurs. <br /> There was no one else present from the general public wishing to <br /> comment on this matter. <br /> Upon motion by Keis, seconded by McGraw, the public hearing was <br /> closed. <br /> Mr. Blesener introduced the following resolution acid moved its adoption: <br /> 5 <br /> <br />
