Hanson <br /> www. ci.little-canada.mn.us <br /> MEMORANDUM <br /> TO: Mayor Blesener and Members of the City Council <br /> FROM: Kathy Glanzer, City Clerk <br /> DATE: January 21, 2010 <br /> RE: Tobacco Ordinance <br /> Katie Engman, Ramsey Tobacco Coalition Program Director, has informed me that City Code <br /> relative to tobacco fines for third violations do not meet the minimums required by State Statute. <br /> While the City Code can impose tougher regulations, it cannot be more lenient than the State <br /> Statute. <br /> Below is a comparison of Little Canada's tobacco violation penalties compared to the minimums <br /> required by State Statute. You will note that Little Canada has tougher penalties for first and <br /> second violations as well as penalties for fourth and subsequent violations which are not <br /> addressed in State Statute. <br /> Little Canada Code State Minimum Reeulations <br /> First Violation $200 $~5 <br /> Second Violation $500 $200 <br /> Third Violation $1,000 or 5 day suspension $250 plus 7 day suspension <br /> Fourth Violation $1,500 or 5 day suspension <br /> Addl. Violations $2,500 plus min.15 day suspension or license revocation <br /> At a minimum, the Council should change the penalty for third violations to mirror State Statute. <br /> However, given the penalty progression from first to third violations in comparison with State <br /> Statute, some additional adjustments appear to be necessary. <br /> cc: Katie Engman <br /> 8 <br /> <br />
