MINUTES

CITY COUNCIL
llECEMBER I6, 2009
storage standards are more stringent. Any amendment to the PUD Permit
would require the site comply with the new standards.
With regard to storage in the cold storage building, the City Administrator
noted most anything other than vehicles could be stored in the cold storage
building. Vehicles cannot be in the building given there is no concrete
floor pursuant to the Building Code.
Fasching felt that the condition of the property has improved, but agreed
there is still more to do. She indicated that what is left will not be very
time consuming.
Keis expressed concern that it has taken nine years to get the property
owner to work on cleaning up the site. I-Ie indicated that he has no
confidence that the project will be completed nor that the property
condition will not deteriorate over the next several months. Keis asked
why Fasching waited until the deadline to get this work done. Fasching
replied that she has evicted one tenant and does not want to evict another.
She felt that only a couple of weeks were needed to complete the clean up
of the property. She indicated that most of the delay was due to financial
issues.
The City Administrator noted that MN Asphalt has moved most of their
equipment from the site. I-Ie noted that this is the off season for asphalt
work, and asked if the equipment will reappear in the spring. Fasching
replied that it would not reappear.
Montour noted from the pictures that MN Asphalt adds plows to its
vehicles during the winter. He noted that now there are plows being
stored on the property. Montour asked if these are being stored in the
proper location. T'he City Administrator replied that they were not. He
noted that MN Asphalt is not permitted outdoor storage. The PUD Permit
for this property only allows outdoor storage for the roofing company and
the electrical company. The Administrator explained the Code relative to
the parking ofpick-up trucks, and noted that commercial vehicles cannot
take up required parking. Large trucks with plows are considered outdoor
storage, and again, MN Asphalt is not authorized any outdoor storage on
the site. These trucks cannot be parked inside the cold storage building as
there is no concrete floor in the building.
Blesener indicated that a lot of work has been done on the site, and he
would like to continue to work with the property owner. The
Administrator noted that the Council can act on the revocation, or extend
the deadline for compliance. Blesener felt an additional 60 days should be
provided. Montour and McCraw agreed, with McGraw indicating that he
7
11
