The I-Iearing Officer's compensation is not contingent on the outcome <br /> of any hearing, and compensation is due for any hearing date scheduled and not cancelled <br /> as stated above, regax•dless of whether people appear for their scheduled hearings. <br /> <br /> 7.0 T11RM AIV~ T)aRMTNATIOIV <br /> 7. I Term <br /> This Agreement shall begin oaa the Effective Date stated above, and run for a period <br /> of two (2) years, unless otherwise terminated prior to that date. <br /> 7.2 Termination <br /> 'T'his Agreement shall terminate in the event that Department terminates, suspends or <br /> otherwise disbands the administrative traffic citations program, effective upon the <br /> date the program ceases operation. <br /> 'T'his Agreement shall terminate in the event that Che I-Tearing Officer accepts <br /> employment with the Department, any agency or department of Ramsey County, the <br /> Minnesota State Patrol, or any of the municipalities contracting with the Department <br /> for law enforcement services. The termination shall become ei'feetive on the date <br /> such employment is accepted. <br /> The parties xnay mutually decide to terminate this Agreement at any time by stating <br /> their intention to terxnlnate the Agreement in writing, signed by each party. Each <br /> party retains the right to unilaterally terminate this Agreement by giving thirty (30) <br /> days' notice to the other party of its intent to withdraw from the Agreement. <br /> 8.0 MTSCELLAN)JOUS <br /> 8.1 Tndexnnity <br /> The Department agrees to indemnify I-Iearing Officer and hold him harmless for any <br /> potential claims, demands, damages or liability that may arise with respect to third <br /> parties due to the performance of duties set out in this Agreement, except and to the <br /> extent that such claims, demands, damages or liability is due to the Hearing Ufticex•'s <br /> misconduct. <br /> 8.2 Force Majeure <br /> Neither party shall be liable for any loss, damage, claim, demand or other liability <br /> arising out of the dekry or interruption of the performance of his obligations under the <br /> Retainer Agreement for Hearing Officer Services <br /> Page 4 of 5 <br /> 5 <br /> <br />
