<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> F>JBRUARY 24, 2010 <br /> McGraw agreed that there should be another meeting with the property <br /> owners, but felt one of the conditions should be that the <br /> Costanzo/Fasching attorney is present at all meetings. McGraw stated that <br /> he wanted to ensure that the property owner was aware of all conditions <br /> and cannot later claim that he/she didn't know or understand what was <br /> agreed to. McGraw pointed out that at a previous meeting when Fasching <br /> and her attorney were present, the Council asked if there was anything that <br /> they did not understand and the answer was no. <br /> Again there was discussion about MN Asphalt with Costanzo asking if <br /> they could stay on the property. McGraw noted that the challenge is the <br /> property configuration, the building location, and the fact that outdoor <br /> storage cannot be in front of the building. <br /> Montour agreed that meetings with Costanzo/Fasching should include <br /> their attorney. He also suggested that at least one Council Member be <br /> present. Keis asked if minutes would be taken, and the Administrator <br /> replied that the Code Enforcement Officer takes notes of these types of <br /> meetings. <br /> Costanzo again asked about allowing MN Asphalt to remain. Again, the <br /> Council's consensus was to have a meeting to see if a compromise could <br /> be reached. Costanzo asked how many vehicles MN Asphalt could have <br /> and how large they could be. The City Administrator suggested Chat any <br /> questions Costanzo and Fasching have that could be submitted prior to the <br /> meeting would be helpful That way the Code can be researched prior to <br /> the meeting and answers readily available. <br /> Costanzo asked if MN Asphalt could stay and suggested that if it were a <br /> matter of money, he would pay tonight. <br /> Mr. McGraw introduced the following resolution and moved its adoption: <br /> RESOL UTION NO. 2010-2-92 -CONTINUING THE PUBLIC <br /> HEARING FOR CONSIDERATION OF REVOCATION OF THE <br /> PUD PERMIT FOR 3151 COUNTRYDRNE UNTIL THE MARCH <br /> 24, 2010 COUNCIL MEETING WITH THE STIPULATION THAT <br /> MEETINGS BEHELD WITH THE PROPERTY OWNERS PRIOR TO <br /> MARCH 24T~i WITH THE FOLLOWING STIPULATIONS: <br /> o COSTANZO AND/OR FASCHING CONTACT THE <br /> CITY BY FEBR UARY 26, 2010 TO SET THE INITIAL <br /> MEETING DATE; <br /> o THE INITIAL MEETING BEHELD PRIOR TO <br /> MARCH 12, 2010, WITHANYSUBSEQUENT <br /> 8 <br /> <br />
