is March 9, 2010 Mr. & Mrs. Gerald Battista 951 Beam Avenue Little Canada, MN 55109-1056 Re: Offer of Compensation for Partial Taking Associated with Right of Way and Easement at 951 Beam Avenue, Little Canada, Minnesota Dear Mr. & Mrs. Battista: As the next step in our ongoing discussions over the City's proposed acquisition of the properties Warned above, the Little Canada City Council last night authorized an offer of $59,000.00 as fair-market compensation for right-of--way and easement acquisitions from your property. I enclose a copy of the appraisal obtained by the City from which the offer of compensation is derived. You will note that we used "Alternative #2 -Fee Taking" for the valuation of the property. Alternative #2 is the layout you stated you preferred. Under Minnesota law, you may obtain an appraisal of the property and Ue reimbursed up to $5,000 for the appraisal cost. The City will pay a reimbursement claim within 30 days of receiving a copy of the appraisal and an invoice of the appraisal costs. The City can also directly reimburse the appraiser, if that is acceptable to you. 'The City has previously discussed the planned public works projects contemplated in your area which require the acquisition of this property. The City Engineer has also worked with you on alignment options to address concerns you expressed. The City wishes to give you as much information about the projects as you require; please contact me if you require any information on the proposed projects.
