<br /> March 9, 2010 <br /> Mr. David Himmmelbach <br /> 2970 LaBore Road <br /> Little Canada, MN 55109-1029 <br /> Re: Offer of Compensation for Partial Taking Associated with Right of Way and <br /> Easement at 2970 LaBore Road, Little Canada, Minnesota <br /> Dear Mr. Himmelbach: <br /> As the next step in our ongoing discussions ovea• the City's proposed acquisition of the <br /> properties named above, the Little Canada City Council last night authorized an offer of <br /> $14,600.00 as fair-market compensation for right-of--way acquisition from your property. <br /> I enclosed a copy of the appraisal obtained by the City fiom which the offer of <br /> compensation is derived. <br /> Under Minnesota law, you may obtain an appraisal of the property and be reimbursed up <br /> to $5,000 for the appraisal cost. The City will pay a reimbursement claim within 30 days <br /> of receiving a copy of the appraisal and an invoice of the appraisal costs. The City can <br /> also directly reimburse the appraiser, if that is acceptable to you. <br /> The City has previously discussed the planned public works projects contemplated in <br /> your area which require the acquisition of this property. The City wishes to give you as <br /> much information about the projects as you require; please contact me if you require any <br /> information on the proposed projects. <br /> The City's first preference is to reach an agreement for direct purchase of the property, <br /> without using eminent domain. Once you have reviewed the appraisal, please contact me <br /> at your earliest opportunity so that we may negotiate a purchase agreement. <br /> The likely time horizon for the City's project is for consh•uction of water and sewer lines <br /> to be completed this summer. As we have discussed, construction of a street on the right- <br /> of-way is not anticipated until such time as you and/or the Battista's develop your <br /> respective properties. <br /> 4 <br /> <br />
