MAYOR
Bill Blesener
~K:, _ COUNCIL
Rick Montour
John I{eis
~ _ ~ Y~/~~ /n iy y~a~a Miohael McG~aw

V _.G.G IJGL~G GGGGGG Shelly Boss
515 Little Canada Road, Little Canada, MN 551 1 7-1600 ADMINISTRATOR
(651) 766-4029 /FAX: (651) 766-4048 Joel R. Hanson
www. ci.little-canada. mn. us
MEMORANDUM
TO: David Himmelbach
FROM: Joel Hanson, City Administrator
DATE: Apri113, 2010
RE: Proposed Terms of Easement Acquisition
Pursuant to your request, this memo will document the terms and conditions proposed by me to you
relative to the City's acquisition of a utility easement impacting your property. Please understand that
this document is subject to the approval of the City Council. I anticipate that approval will be granted at
tonight's Council Meeting. Ideally, it would be nice to know prior to or at the meeting if these proposed
terms are acceptable to you. The terms are as follows:
? You will dedicate a 50-foot utility easement to the City in the area approximated on the attached
diagram. The utility easement cannot be used to consriuct a streethoad without acquiring
additional rights from you. The City anticipates the road right-of--way will ultimately be
dedicated by you (or the property owner at the time) when the property is developed pursuant to
the City's subdivision ordinances. As T have stated to you on numerous occasions, the City is
not interested in constructing a road that does not benefit abutting property.
? The amount of compensation paid will be as follows:
Easement-9, 750 Sq. Ft. @ $1.275/sq. ft. = 12,400
Appraisal Allowance = 2,500
Eminent Domain Avoidance = 15,000
Total Compensation = 29 00
? You will be specially assessed for benefits received resulting from the construction of the
sanitary sewer line across your property. The estimated assessment to youl• property is based on
a cost per lot of $13,027 multiplied by an estimated three (3) lots totaling $39,081. The exact
amount of the assessment will be determined after the project is bid and constructed.
? The special assessments will be deferred until such time as the benefitted property is developed.
? Interest will accrue on the deferred assessments. The rate of interest for acciual purposes is
expected to be between 4.5% and 5.0 percent. Interest is not compounded.
? No water main will be installed at this time. Should it be deemed necessary to do so in the
future, this easement would permit that. However, the City does not feel water main needs to be
installed until your and/or the Battista property are developed. A primary reason is water main
