6. Area does not take up parking space as required for conformity to this <br /> Ordinance. <br /> 7. The provisions of Section 921.O10.C of this Ordinance are considered <br /> and satisfactorily met. <br /> 8. No outdoor storage area shall include storage of materials that are <br /> considered hazardous materials by the Minnesota Pollution Control <br /> Agency. <br /> 9. No outdoor storage shall be permitted in any yard except the rear yard <br /> of the property. In any yard, no outdoor storage area in the 1-P, Industrial <br /> Parlc Dish~ict, shall be closer to any property line than ten (10) feet. <br /> Since the Orius CUP expired, the City made changes to the I-P outdoor storage <br /> <br /> allowances. The primary change relates to the amount of allowable storage area, <br /> subdivision 1 of the CUP section. The Orius permit was granted under regulations that <br /> allowed up to 75% of the building area and 25% of the lot. As can be seen, the current <br /> regulations are 25% of the building area or 10% of the lot. <br /> <br /> The building is 50,000 square feet, on 6.6 acres The current storage area is 37,500 <br /> square feet, equal to 75% of the building, and 13% of the lot area. The storage area is <br /> an existing non-conformity, and the applicants propose to occupy only a small area of <br /> <br /> the yard, estimated by the applicants to be just 10% of the current yard. At that amount, <br /> <br /> the storage area would be within the limitations imposed by the current ordinance. The <br /> applicants have indicated that they primarily need the storage area for materials that will <br /> be picked up for recycling or other use, along with a few smaller pieces of equipment. <br /> The storage area is fenced with chain-link fencing that include slats, and a combination <br /> of trees and shrubs outside of the fence. <br /> Summary and Recommendation <br /> The proposed outdoor storage appears to be in compliance with the terms of the current <br /> zoning ordinance requirements, although the current enclosed yard is larger that what <br /> the ordinance allows. That enclosed area was developed under previous regulations, <br /> and exists as a legal non-conformity. No changes to the site are proposed to occur as <br /> part of this application, and the applicant proposes to occupy a much smaller area than <br /> would be allowed under the zoning regulations.
