Except for construction equipment which is stored or parked in its most <br /> compact condition, outdoor storage may not exceed eight (8) feet in height <br /> as measueed from the ground on which it is located. The submission does <br /> not detail the height of the storage, however it appears to meet the <br /> standard as shown -this requirement shall be a condition of approvah <br /> 9. The storage area shall be fenced and fully screened from adjoining non- <br /> indush•ial property, park and trail areas, and public right of way. Where <br /> properly fenced and screened, outdoor storage may encroach into the <br /> required side or rear yard setback area. The applicant is seeking approval <br /> for the existing enclosure. It does not appear that the storage is visible <br /> from Spruce Street. <br /> 10. Screening shall consist of masonry walls or fencing constructed of wood <br /> or vinyl, as well as landscaping. Metal fencing may be used where <br /> landscaping provides a complete year-round screen and is irrigated to <br /> ensure survivability in compliance with Section 903.020.F (Pence <br /> section). See comment for Item 9 above. <br /> 1 Waste or recyclable material shall be contained in a refuse container. All <br /> such containers shall be stored within a screened enclosure within the rear <br /> yard of the property. A site plan should be prepared that verifies location <br /> of waste containers. <br /> 12. The storage area shall be paved with asphalt, concrete, or other material <br /> approved by the City Council. Storage area surfacing is identified as <br /> gravel surface. <br /> 13. The storage area shall not occupy any space required for conformity to the <br /> parking regulations of the Zoning Ordinance. The applicant's site photo <br /> shows the location of existing and new parking to meet the zoning <br /> ordinance parking requirements. <br /> 1~}. The properly, including buildings and exterior site areas, shall comply <br /> with all applicable fire codes. The fzre chief should comment on <br /> compliance with this regulation. <br /> I5. All lighting shall he hooded and so directed that the light source shall not <br /> be visible from the public right-of way or from neighboring residential <br /> uses, and shall be in compliance with Section 903.020.I of the Zoning <br /> Ordinance. The plan does not detail the layout of the site lighting -this <br /> requirement shall be a condition of approval. <br /> 16. All other provisions and requirements as deemed necessary by the City <br /> Council. <br /> 17. The applicant complies with the provisions of Section 921 of the Zoning <br /> Ordinance. <br /> <br /> Summary and Recommendation <br /> If the property remains I-P, the applicant shall be required to show compliance with any <br /> original approvals from the time of its construction, prior to the adoption of the I-P <br /> zoning district. In this situation, the outdoor storage area would be legally non- <br /> conforming, and permitted to continue in tis current condition. <br /> If the property is rezoned to I-1, the applicant will need a new CUP under the revised I-1 <br /> zoning district regulations.
