<br /> As noted, the applicants suggest that the applicable conditions in their case include: <br /> i. Size and shape of lot that restrict further building; <br /> ii. Closer adherence to the intent of the ordinance (aesthetics and <br /> public safety) with containers rather than open materials storage <br /> iii. By utilizing containers, the extent of the storage area can be <br /> restricted to a smaller area and be less visible. <br /> Summary and Recommendation <br /> The applicants' site plan shows compliance with each of the requirements of the new <br /> ordinance, with the exception of the number of containers proposed. As such, planning <br /> staff would recommend approval of the CUP, subject to one of the following: <br /> a. Compliance with the 4-container maximum; OR <br /> b. Approval of a variance for the proposed additional container storage. <br /> With regard to the variance, the zoning ordinance establishes a set of criteria for <br /> variance consideration that are designed to demonstrate how the regulations would <br /> create a hardship in putting the property to reasonable use, and how this property is <br /> distinguished from others in the same district. If the City is to consider the variance, the <br /> following findings should be included: <br /> 1. The variance is necessary to put the property to reasonable use. <br /> 2. Approval of the variance results in a site condition that is closer to the intent of <br /> the City's zoning regulations that open storage would be (better organization and <br /> less site clutter). <br /> 3. Due to the size of the property, layout of the circulation, and size of the existing <br /> building, building expansion on this site is not feasible. <br /> 4. The containers permit a smaller are of the site to be used for outdoor storage <br /> than if the equipment were to be stored in the open. <br /> 5.
