Hanson <br /> www. ci.little-canada. mn. us <br /> MEMORANDUM <br /> TO: Planning Commission Members <br /> FROM: Jessica Jagoe, Code Enfw•cement Officer <br /> DATE: October 6, 2010 <br /> RE: 3171 Spruce Street -Conditional Use Permit Amendment <br /> Mr. Dan Neujahr, Property Owner of 3171 Spruce Street, is seeking an amendment to the curl•ent <br /> Conditional Use Permit to allow outdoor storage for tenants of the building up the maximum <br /> allowed by code (60% of the site). The CUP issued in 1999 indicated specific outdoor storage <br /> fm• materials and equipment relating to the occupants of the property at that time. Since then Mr. <br /> Neujahr• has new tenants and as a result the outdoor storage needs have changed. <br /> In the I-1 zoning district outdoor storage is allowed as an accessory use by CUP. I have outlined <br /> below the code provision for outdoor storage with staff comments inserted as italics: <br /> G. Open and Outdoor Storage as an accessory use, provided that: <br /> 1. The activity of outdoor storage shall require a separate business license <br /> issued by the City of Little Canada. The app[icnnt will have to obtain this <br /> license. <br /> 2. The storage area in question occupies an area no greater than sixty percent <br /> (60%) of the gross square footage of the subject parcel. City staff bas <br /> reviewed the site plmz subzzzitted Gy Mr. Neujahr and the outdoor storage <br /> area shown is about 40% of the site (staff mensured the "x"areas on the <br /> plan). However, the site plan also indicates rear yard storage in the <br /> center of the site plan. If staff measures the rear yard behind the <br /> screening the outdoor storage area would comprise of about SS% of the <br /> site (almost to the maximum allowed by code). Prior to approval, staff <br /> would recommend Mr. Neujahr submit a new site plmz confirming <br /> where said outdoor storage will occur. If tkere nre areas behind the <br /> screening that are not intended for storage Mr. Neujahr should indicate <br /> on the site plan (drive aisles, parking, fire lanes, etc.). This will enable <br /> city staff to verify tl:at the intended outdoor storage area stays below the <br /> <br />
