CITY OF LITTLE CANADA <br /> ORllINANCE NO. <br /> <br /> !AN ORDINANCE AMENDING CHAPTER 1100. OF THE LITTLE CANADA CITY CODE, <br /> KNOWN AS THE MUNICIPAL CODE, ENACTING RESTRICTIONS ON THE FEEDING <br /> of w1L,DLIFE <br /> The City Council of the City of Little Canada hereby ordains: <br /> Section 1. <br /> Chapter 1100 is hereby amended to add Section 1106 which reads as follows: <br /> 1106.010. FEEDING OF WILDLIFE RESTRICTED. No person may place any salt, <br /> mineral, grain, fruit or vegetable material, or other food source outdoors on any public or private <br /> property for the purpose of feeding whitetail deer, geese, ducks, turkeys, pigeons, seagulls, or <br /> other wild animals or fowl. <br /> 1106.020. PRESUMPTION. There shall be a rebuttable presumption that either of the <br /> following acts are is for the purpose of feeding wildlife: <br /> (A) The placement of salt, mineral, grain, fruit or vegetable material, or other food <br /> source ' ° ^ at the a height oP <br /> less than six feet off the ground. <br /> (B) The placement of salt, mineral, grain, fait or vegetable material, or other food <br /> source ~=~~a=:,`~, <br /> °'^~~...abic Est in a drop feeder, <br /> automatic feeder or similar device regardless of the height of the grain, fruit or <br /> vegetable material. <br /> l 106.030. EXCEPTIONS. This ordinance shall not apply to the following situations. <br /> (A) Naturally Growing Materials. Naturally growing grain, fruit or vegetable <br /> material, including gardens, landscaping, and residue from lawns, gardens, and <br /> other vegetable materials maintained as a mulch pile. <br /> (B) Bird Feeders. Unmodified, commercially purchased bird feeders or their <br /> equivalent; subject to a one cubic foot volume limit for all feeders placed on <br /> private property and including any food material that has dropped on the ground <br /> from the feeder. <br /> (C) Veterinarians, city, county, state, or federal officials, who in the course of their <br /> duties have wild animals in their custody or under their management. <br /> 1106.040. PENALTY. Any person who violates this Ordinance is guilty of a <br /> misdemeanor, and shall, upon conviction thereof, shall be punished by imprisonment for up to <br /> ninety days, a fine of up to one thousand dollars, or a combination thereof. <br /> <br />
