14. Provisions are made to control and reduce noise. <br /> 15. No outside storage except as allowed in compliance with Section 912- <br /> A.040.M of this Ordinance. <br /> 16. Sale or products other than those specifically mentioned in this subsection <br /> shall be subject to a conditional use permit and be in compliance with Section <br /> 912- A.040.M of this Ordinance. <br /> 17. All conditions pertaining to a specific site are subject to change when the <br /> Council, upon investigation in relation to a formal request, finds that the general <br /> welfare and public betterment can be served as well or better by modifying the <br /> conditions. <br /> 18. The provisions of Section 921.O10.C of this Ordinance are considered and <br /> satisfactorily met. <br /> 19. A protective canopy located over the pump island may be allowed as an <br /> accessory structure on the property and may be located twenty (20) feet or more <br /> from the front yard or side yard property line, provided that adequate visibility <br /> both on and off site is maintained. <br /> <br /> The changes to the site do not result in significant impacts on the current condition or <br /> <br /> the required conditions, many of which are more applicable to motor fuel sales rather <br /> than auto repair. The applicant has worked with the City Engineer to ensure that any <br /> stormwater impacts have been accounted for, and the applicant has proposed <br /> additional planting of eight spruce trees adjacent to the new parking area as a part of <br /> the project. The project site is surrounded by commercial zoning, and as such, does not <br /> impact any residentially-zoned areas. <br /> With regard to the Architectural Guidelines, the applicants have proposed to construct <br /> the addition of materials similar to those of the existing building. Because the addition is <br /> at the rear of the site and has limited visibility, no architectural issues are anticipated. <br /> Summary and Recommendation <br /> The proposed CUP amendment appears to be consistent with the requirements for such <br /> uses in the B-4 District, and the addition can be accommodated on the existing site. <br /> Planning staff recommends approval of the CUP amendment, based on a finding that <br /> the applicant's engineering plans are acceptable to the City Engineer, and that the <br /> proposed building addition will not impact existing conditions or code issues on the <br /> subject property. <br /> Staff recommends approval of the CUP, subject to a continuation of the applicable <br /> conditions attached to the original approval in 2000 (some of those conditions are no <br /> longer applicable following construction of the original building): <br /> 1. No auto repair may occur outside the principal building and the service bay doors <br /> are to remain closed at all times except when moving vehicles in/out of the <br /> building. <br /> 2. No outdoor storage will be allowed except for trash and refuse stored within the <br /> enclosure and vehicles for service within the designated parking stalls. <br /> 16 <br /> <br />
