MINUTES <br />CITY COUNCIL <br />NOVEMBER 22, 2010 <br />the file that can be used to verify the Nielsen's claim that outdoor storage <br />was legally established. The City Administrator indicated that it may be <br />appropriate to rezone this property back to I -1. He suggested that this <br />evening the Council table action on the matter until the January 26 °i <br />Council meeting. In preparation for that meeting, staff will research the <br />record further and have a recommendation for the Council. <br />McGraw asked if the Council had the ability to negotiate with one <br />property owner versus another. The City Attorney indicated that <br />conditions placed on CUP's are discretionary. However, if CUPS for <br />similar properties are being considered at the same time, the conditions <br />should then be similar. <br />The City Attorney reported that he and City staff will continue to review <br />the records and will identify those properties that may have grandfathered <br />rights. It was felt that there are very few of these properties, perhaps 6 or <br />7 out of a total of approximately 44. A recommendation for the <br />harmonizing of grandfathered rights with existing CUP's will then be <br />presented to the Council for ratification. <br />The Council asked about the properties north of Ryan Drive. It was noted <br />that at no time was outdoor storage allowed in front of a building. <br />Therefore, none of these properties will have grandfathered rights of that <br />nature. <br />At this point in the meeting, the Council discussed the issue of outdoor <br />storage licensing. The City Administrator reported that there are some <br />properties that are not compliant with CUP conditions; therefore, the Code <br />requirements relative to temporary licensing would apply. The <br />Administrator noted that staff is prepared to implement the temporary <br />license fees and if not received, to process revocations of conditional use <br />permits. He asked if the Council concurred with this approach. It was the <br />consensus of the Council that the Code should be enforced.
