The manufacturing, compounding, assembly, packaging, treatment, or storage of <br />products and materials. Expressly prohibited activities include: the stockpiling <br />and recycling of aggregate materials in supplies of more than twenty -five (25) <br />cubic yards. <br />Under this language, an asphalt plant could conceivably locate in Little Canada as a use <br />that involves the "compounding" of materials. However, the restriction on stockpiling of <br />aggregates would make such a use difficult to operate, since all supplies would have to <br />be trucked in from off -site as they are being used. <br />In the 1 -2 zoning district, Aggregate Materials Stockpiling is allowed by Interim Use <br />Permit, with a number of restrictions, including that such a use must be the exclusive <br />use of the property on which it is located. The Fra -Dor aggregates recycling operation <br />exists under such a permit, the only 1 -2 district in the City. <br />Concern has been raised that some combination of the two uses on adjoining or nearby <br />locations would support the feasible operation of an asphalt plant. Thus, staff has <br />developed a provision that would prohibit such uses in the City. Moreover, because <br />concrete plants and other aggregate materials processing could raise many of the same <br />issues, the amendment language would prohibit all such uses as permanent occupants <br />of property. <br />There are some necessary exceptions to accommodate ongoing construction projects. <br />It is not uncommon for temporary paving materials to be produced on -site during large <br />construction projects, especially highway construction or very large building projects. <br />As such, the amendment is designed and written to accommodate certain temporary <br />facilities for a limited time, in limited locations. <br />Proposed Amendment. <br />The proposed amendment creates a category of "Prohibited Uses" in the 1 -1 and 1 -2 <br />Districts, and adds a clarifying statement in the district language that calls attention to <br />this category. <br />Permitted Uses in the 1 -1 (Section 914.020) and I -P (Section 918) would be <br />amended to introduce the new Prohibited Uses subsection; <br />Asphalt Plants, Concrete Mix Plants, and other Aggregate Materials Processing <br />are list as Prohibited Uses in that section. <br />The ordinance amendment further adds the Stockpiling and recycling of <br />aggregate materials up to 25 cubic yards as an accessory use subject to the <br />City's new Outdoor Storage provisions; and <br />Moves the Stockpiling restriction of more than 25 cubic yards to the new <br />Prohibited Uses section. <br />Finally, the proposed amendment adds temporary use of such facilities as an <br />accessory use where an active building permit has been issued, or where a <br />public agency is constructing a road or bridge project. <br />
