MINUTES <br />CITY COUNCIL <br />JANUARY 12, 2011 <br />The next issue reviewed related to license term. The City Administrator <br />noted that getting the rental licensing program underway has taken more <br />time than originally estimated. The first year's license was to run through <br />June 30 of 2010. The Administrator recommended that in order to given <br />the City more time to achieve compliance with nonresponsive properties <br />as well as implement the ordinance changes being discussed this evening, <br />it would be his recommendation that the first license period run through <br />June 30, 2011, with the license then being issued on an annual basis <br />commencing July 1, 2011. The Council was in agreement with that <br />recommendation. <br />There was additional discussion relative to the license fee, and it was the <br />consensus of the Council to retain the current license fee levels given that <br />the licensing program is still evolving, and the City will need to modify <br />the ordinance as well as have licensing software modifications made. <br />The Council then discussed the requirement for annual inspections <br />required for 25% of the rental units in larger complexes so that all units <br />are inspected every four years. It was suggested that some of these rental <br />complexes may desire to have all units inspected at one time rather then <br />spreading inspections out over a four year period. The Council indicated <br />that as along as all units are inspected once every four years, they did not <br />feel it necessary to hold a property owner to the requirement of 25% of <br />units inspected each year. <br />The City Administrator noted that rental property owners have requested <br />that other inspections they are required to have of their properties, such as <br />HUD inspections, be substituted for the inspection required by City <br />ordinance. It was the consensus of the Council that it would consider this <br />request after the initial four year period, to ensure that all rental units have <br />been inspected by as required under the ordinance. <br />The City Administrator then addressed the issue of a "provisional license" <br />as was previously allowed by State Statute. There was discussion of the <br />fact that this was an effective licensing tool in the Cities of New Brighton <br />and Brooklyn Park. He suggested that he contact the League of MN Cities <br />relative to supporting legislation that would again allow cities to do <br />provision rental housing licensing.
