All other provisions and requirements as deemed necessary by the City Council. <br />The proposed storage area appears to be compliant with these requirements, with the <br />note that the applicant much request an inspection from the fire department to verify <br />consistency with the fire safety aspects of the existing and proposed conditions. With <br />regard to total storage area, the parcel size is 81,893 square feet, and the building <br />square footage is approximately 27,500 square feet. According to the code <br />requirements, the storage area could be as much as 8,189 square feet by lot area, or <br />about 6,865 square feet by building area, meaning the maximum outdoor storage would <br />be 6,865 square feet. As proposed, the applicant's proposed storage area of 6,000 <br />square feet (50 feet wide by 120 feet long) would fall within the allotted code standard. <br />Variance for location in a side yard. As noted above, the Industrial Park district <br />requires that outdoor storage is not be allowed in any yard other than a rear yard. In the <br />2006 application, the City granted a variance based generally on findings that the <br />orientation of the property made the use of the north lot area unusable for storage, since <br />it was not attached to most of the tenant areas of the building, and that storage in that <br />location would interfere with business and truck traffic circulating around the building. <br />Variances are to be judged by a specific set of conditions as identified in the Zoning <br />Ordinance, as follows: <br />1. In considering all requests for a variance and in taking subsequent action, the City <br />staff, the Planning Commission, and the City Council serving as the Board of <br />Adjustment and Appeals shall make a finding of fact that the proposed action will not: <br />a. Impair an adequate supply of light and air to adjacent property. <br />b. Unreasonably increase the congestion in the public street. <br />c. Increase the danger of fire or endanger the public safety. <br />d. Unreasonably diminish or impair established property values within the <br />neighborhood, or in any way be contrary to the intent of this Ordinance. <br />e. Violate the intent and purpose of the City Comprehensive Plan. <br />2. A variance from the terms of this Ordinance shall not be granted unless it can be <br />demonstrated that: <br />a. Special conditions and circumstances exist which are peculiar to the land, structure, or <br />building involved. <br />(1) Special conditions may include exceptional topographic or water conditions <br />or, in the case of an existing lot or parcel of record, narrowness, shallowness, <br />insufficient area or shape of the property. <br />(2) Special conditions and circumstances may not be primarily economic in <br />nature. <br />b. Literal interpretation of the provisions of this Ordinance would deprive the applicant of <br />rights commonly enjoyed by other properties in the same district under the terms of this <br />Ordinance. <br />c. The special conditions and circumstances do not result from the actions of the <br />applicant. <br />d. Granting the variance requested will not confer on the applicant any special privilege <br />that is denied by this Ordinance to other lands, structures, or buildings in the same <br />district. <br />e. A genuine hardship exists in complying with the literal terms of this Ordinance. <br />
