Once licensed a <br />has current. completed inspections of all units at the time of <br />making its renewal application may be granted a renewal license valid <br />from July 1 of the renewal year through June 30, 2013. <br />Section 2 <br />Insert a new Section 3200.045: <br />3200.045: PENALTIES FOR FAILURE TO OBTAIN A LICENSE. <br />A. Fees Doubled. A person or entity found by the City Administrator to be leasing a unit <br />upon rental property without a license from the City must obtain a license before <br />allowing continued occupancy of the rental unit or letting new leases of the rental unit. <br />The application fees for any application made in this circumstance shall he twice those <br />published by the City Council for license applications made under this Chapter. <br />B. Misdemeanor. Any person, partnership, business entity or corporation leasing a unit <br />upon real property without first obtaining a license from the City as required by Section <br />3200.040(A) shall be guilty of a misdemeanor. Each day on which an unlicensed rental <br />unit is occupied in violation of this Chapter shall he a separate violation. Upon <br />conviction, the offending party may be fined and confined up to the maximum amount <br />permitted by Minnesota Statutes for each misdemeanor offense. <br />C. hljunction. If the City Administrator believes that an unlicensed unit upon real <br />property continues to he occupied following written notice to the person or entity owning <br />the real property, the Administrator may direct that the City Attorney proceed with an <br />action to have the unlawful occupancy enjoined in Ramsey County District Court. A <br />misdemeanor summons for violation of this Chapter served upon the owner of the <br />property is sufficient written notice for purposes of this section. <br />D. Remedies Non - exclusive. The City may take one or more of the enforcement actions <br />described above in response to any one violation. Use of one remedy does not preclude <br />the City from seeking enforcement of this Ordinance through any legal means authorized <br />by the city code, state or Federal law. <br />Section 3 <br />SUMMARY PUBLICATION. Pursuant to Minnesota Statutes Section 412.191, in the <br />case of a lengthy ordinance, a summary may be published.
