ADDENDUM TO MANUFACTURED HOME <br />BUY /SELL AGREEMENT <br />This is an Addendum to the Manufactured Home Buy /Sell Agreement between <br />the City of Little Canada ( "City ") and Timothy Dinneen and is made as of the day <br />of , 20110 by and between the City and Mr. Dinneen. <br />RECITALS <br />WHEREAS, the City needed to purchase the manufactured home owned by Mr. <br />Dinneen located at 2442 Rice Street, Lot A, Little Canada, MN 55113. <br />WHEREAS, as a result of the City's need to acquire Mr. Dinneen's <br />manufactured home, he was deemed to be eligible for relocation benefits pursuant to the <br />Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as <br />amended, 49 C.F.R 24 and as adopted by the State of Minnesota via Minn. Stat. §117.52. <br />WHEREAS, the City offered to purchase Mr. Dinneen's manufactured home for <br />$1,600.00 based upon the estimated market value for his manufactured home as <br />determined by Ramsey County. <br />WHEREAS, Mr. Dinneen was informed by the City's relocation consultant, Jon <br />W. Morphew of Schnitker Law Office, P.A., that when he moved he could choose either <br />(1) a payment for his actual reasonable moving and related expenses, or (2) if he <br />preferred, he could chose a fixed moving expense and dislocation allowance of <br />$1,650.00. <br />WHEREAS, Mr. Dinneen was also informed by Mr. Morphew that he was <br />entitled to a Purchase Price Differential because it was determined that a comparable <br />replacement manufactured home would cost him more than the value of his current <br />manufactured home and that he was eligible to receive a purchase price differential <br />payment up to $16,900.00. <br />WHEREAS, Mr. Morphew informed Mr. Dinneen that the Purchase Price <br />Differential was based upon the identification of a comparable replacement dwelling <br />located at 2442 Rice Street, Lot #95, Little Canada, MN 55117, with an asking price of <br />$18,500.00. <br />WHEREAS, Mr. Dinneen asked Mr. Morphew if it was possible for the City to <br />purchase a comparable replacement dwelling on his behalf and transfer it to him as he <br />could not obtain traditional financing to purchase a replacement dwelling on his own. <br />NOW, THEREFORE, in consideration of the foregoing and other good and <br />valuable consideration, the receipt and sufficiency which are hereby acknowledged, Mr. <br />Dinneen and the City agree to the following: <br />14 <br />
