MINUTES <br />CITY COUNCIL <br />MARCH 23, 2011 <br />has one way in an out and he did not want the project to impact school <br />buses. The Engineer also noted that delaying the project until June 2011' <br />would allow a couple of weekends for graduation parties. A project <br />information sheet will be prepared and distributed to property owners. <br />Jack Desai noted that his driveway area will be shortened given the street <br />pavement will be five feet closer to his property line. Desai asked if the <br />Council would support a variance should he need to make some <br />modifications to his driveway as a result of having less driveway area. <br />The Engineer noted that the City Code allows driveways to be up to 3 feet <br />from the property line. Mr. Desai has discussed the possibility of <br />widening his driveway closer than the 3 foot setback from the property <br />line. It was noted that the required front yard setback of 30 feet was being <br />maintained. Mrs. Desai noted that they have an RV parked in their <br />driveway. That, coupled with a shorter driveway as a result of the project, <br />may result in their not being enough visitor parking on the driveway area. <br />Montour noted that the Council would have to consider the facts at the <br />time that a variance application is made. <br />Mrs. Desai noted that they may lose several mature pine trees given the <br />pavement is shifting toward their property. The City Engineer indicated <br />that only trees within the right -of -way will be impacted. It would he his <br />plan to replace these with 8 foot trees and plant them inside the property <br />line with the Desai's permission. <br />The property owner at 2410 Dianna Lane asked if trees lost as a result of <br />the project would be replaced. The City Administrator indicated that trees <br />that are typically removed are within the right -of -way. However, if a tree <br />on private property dies because of project impact, it is the City's intention <br />to make the property owner whole, and that tree would likely be replaced. <br />The City Administrator noted that this is a public hearing to consider the <br />assessment of the cost of the Dianna Lane improvement. He indicated that <br />if there are any property owners who wish to contest their assessment, <br />they must file a written objection at this hearing. The City Council will <br />then act on the objection. <br />Jack Desai noted that the project bid is approximately $130,000 less than <br />the estimate, yet the City is not passing any of these savings on to <br />properties being assessed. Desai also indicated that it was his feeling that <br />there was no benefit to 2345 Arcade Street, therefore, he felt that property <br />should not be assessed. The City Administrator indicated that the <br />proposed assessment is not based on the hid amount, but the assessment <br />cap. The Administrator indicated that the City's methodology in capping <br />assessments equalizes project assessments for all areas of the City. He <br />4 <br />
