MINUTES <br />CITY COUNCIL <br />MARCH 23, 2011 <br />Council's consensus was that the City would absorb the cost that was <br />proposed to be assessed against 2345 Arcade Street, rather than increasing <br />the Dianna Lane assessment. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -3 -59 — AMENDING THE DIANNA LANE <br />ASSESSMENT ROLL, DELETING THE ASSESSMENT PROPOSED <br />FOR 2345 ARCADE STREET IN IT'S ENTIRELY, AND <br />DECLARING THAT THE CITY WILL PAY AND OFFSET THE <br />COST OF THIS ASSESSMENT, WITH THIS ACTION BASED ON <br />THE FOLLOWING: <br />o *THE DIANNA LANE RETAINING WALL PREVENTS <br />2345 ARCADE STREET FROM HAVING ACCESS TO <br />DIANNA LANE; <br />o *2345 ARCADE STREET HAS NO DEVELOPABLE <br />PROPERTY WITHOUT HAVING ACCESS TO <br />DIANNA LANE; <br />o *THE DEVELOPMENT OF THE DIANNA LANE <br />PLAT RESULTED IN 2345 ARCADE STREET <br />BECOMING A CORNER LOT; <br />o *2345 ARCADE STREET WAS NOT A PART OF THE <br />DIANNA LANE PLAT <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />There was no one present from the general public wishing to make <br />additional comments on this matter. <br />Upon motion by McGraw, seconded by Boss, the public hearing was <br />closed. <br />The Council noted that no written objections to the Dianna Lane <br />assessment were filed or received by the City. <br />Montour asked about the surmountable curb issue, and suggested that <br />additional discussion with the property owner was necessary. McGraw <br />agreed, and indicated that additional information was needed before he <br />could make a decision on this issue. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />6 <br />
