802.050. LICENSE FEE. The annual Tobacco Products license fee shall be determined by <br />resolution of the City Council. If the application is made after January 1, the annual fee shall be pro- <br />rated on a monthly basis. <br />802.060. TERM. Tobacco Products licenses shall be for a term of one year. The annual <br />Tobacco Products license shall commence July 1 of each year. <br />802.070. LICENSE RESTRICTIONS. A license shall be issued subject to the following <br />restrictions: <br />(a) Vending machines used to dispense Tobacco Products shall be prohibited unless the <br />following conditions are met: <br />(1) The vending machine shall be operable only by the activation of an electronic <br />switch operated by an employee of the licensee before each sale, or by <br />insertion of a token provided to the purchaser by an employee of the licensee; <br />and <br />(2) The vending machine shall be located in the immediate vicinity, plain view <br />and control of a responsible employee of the licensee, so that all purchases <br />will be readily observable by the employee of the licensee. The vending <br />machine shall not be located in a coatroom, restroom, unmonitored hallway, <br />outer waiting area or similar unmonitored areas. The vending machine shall <br />be inaccessible to the public when the establishment is closed. <br />(b) Other than Tobacco Products packaged in cartons containing at least ten (10) <br />individually packaged Tobacco Products, a licensee shall not offer for sale or <br />otherwise dispense any Tobacco Product by self - service merchandising. <br />(0) <br />A licensee shall comply with all applicable regulations of the State of Minnesota <br />relating to the sale or dispensing of Tobacco Products. If there is a conflict between <br />the regulations of the State and the regulations of the City, the more restrictive <br />regulations shall control. <br />(d) Every licensee is responsible for the conduct of its employees while on the licensed <br />premises. Any sale or other disposition of Tobacco Products by an employee of a <br />licensee to a person under eighteen (18) years of age shall be considered an act of the <br />licensee. <br />802.080. SALES TO MINORS. No person shall give, sell or dispense any Tobacco Product <br />to a person under eighteen (I 8) years of age. Any person convicted of violating this section shall pay <br />a fine of $100.00 for the first such conviction. Any person convicted of violating this section twice <br />shall pay a fine of $125.00. Any person convicted of violating this section three times shall pay a <br />802 -2 <br />10 <br />
