MINUTES <br />CITY COUNCIL <br />SEPTEMBER 20, 2010 <br />REZONE & <br />CUP — 3075 <br />SPRUCE <br />STREET — <br />TOM NIELSEN <br />CUPs & <br />VARIANCE — <br />3150 SPRUCE <br />STREET — <br />EICH AUTO <br />SALES <br />Mayor Blesener noted that Mr. Tom Nielsen has requested that action on <br />his request for the Rezoning of his property located at 3075 Spruce Street <br />from Industrial Park (I -P) District to Light Industrial (I -1) District as well <br />as Conditional Use Permit for outdoor storage be tabled until the October <br />27, 2010 Council Meeting. The Nielsen's have signed a 60 -day waiver <br />relative to their request to table. Blesener noted that the Nielsen's would <br />like to have additional discussion with the City Planner relative to their <br />options. <br />Montour asked if the matter would be sent back to the Planning <br />Commission. The City Planner stated that the expectation would he that it <br />is sent directly to the City Council on October 27, 2010. However, if the <br />proposal is significantly changed, the matter would go to the Planning <br />Commission first. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2010 -9 -222 — CONTINUING THE PUBLIC <br />HEARING ON THE NIELSEN REZONING AND CONDITIONAL <br />USE PERMIT APPLICATION FOR 3075 SPRUCE STREET UNTIL <br />THE OCTOBER 27, 2010 COUNCIL MEETING AS REQUESTED BY <br />MR. TOM NIELSEN <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Mayor Blesener opened the Public Hearing to consider the application of <br />Eich Auto Sales, 3150 Spruce Street, for a Conditional Use Permit for <br />motor vehicle sales lot, Conditional Use Permit for open and outdoor <br />storage, and a Variance from the City's screening requirements. It was <br />noted that the Planning Commission recommended approval of both <br />Conditional Use Permits subject to compliance with the recommendations <br />of the City Planner as outlined in his report dated September 2, 2010. The <br />applicants withdrew their Variance request based on the City Planner's <br />indication that screening of the rolling gate is not required by Code. <br />The City Planner reported that Eich Auto Sales has requested a <br />Conditional Use Permit for outdoor auto sales and display. He noted that <br />the Code would allow a maximum of 10 vehicles under this CUP. Given <br />that the applicant is proposing to have more than 10 vehicles, they have <br />also applied for a CUP for outdoor storage. As a result, the vehicles over <br />3 <br />16 <br />
